The paper deals with the relevance of hypothetical causal courses for the im-putation of harmful events to negligent conducts. The author focuses on the teleologicalprofile of the “duty of care” in order to discuss the adoption of the “increase of risk” –or“decrease of chances”– ex post normative criteria. The discussion clarifies the relationshipbetween the evaluation concerning the “realization of risk” (i.e. the “scope of protection” ofthe norm) and the consideration of the hypothetical lawful conduct. This allows reaffirmingthe structural correspondence between negligent “active conducts” and negligent “improperomissions”. Finally, the paper considers the relevance of the defended theoretical structure byfocusing on medical malpractice cases for diagnostic errors.

There is a perception of a crisis of the civil justice in the comparative law arena.This crisis would be one of access as one of relevance. From this critics, which provides anew insight to the existing studies in Chile, this article provides the findings of an empiricalresearch over civil courts of Santiago, which shows, from this point of view, a state of affairseven worst from what is described in our legal community. From its findings, I propose a re-orientation of the reform process focusing on access to formal justice and reassessing its valuefor the Rule of Law.

 This article aims to draw attention to the discussion regarding the moments ofevidentiary activity, and the problems that each one of those steps could engender, to familylaw process, specifically to the reformed proceedings enshrined in the Act Nº 19.968. In ac-cordance with its structure and ruling principles, it is possible to acknowledge the momentsof conformation, evaluation and the application of a standard of proof, evidencing the prob-lems and risks attached to every stage of the corroborative activity performed by parties andadjudicators. This work expects to present and describe, with no exhaustive ambition, someof the aforementioned issues, taking charge of the unsatisfactory application of evidence lawto family proceedings given the recent increase of powers entrusted to Family Courts.

The present article aims to perform a critical analysis of the denomination ofcollaborative actions as neutral and how this has affected ist proper treatment as complicity inthe German doctrine and jurisprudence. These are behaviors that appear to be harmless, butenable the realization of a crime through its execution or omission, raising the question aboutthe conditions (objective or subjective) that must be verified in a collaborative behavior in or-der for a subject to be attributed as title of complicity the unjust committed by another. Afterexposing the theoretical problem that this category aims to cover, we will try to demonstrate,in first place, the incorrectness of the denomination and, with it, the habitual starting point forthe treatment of this group of cases, this is to analyze the assumptions under which a behaviorloses its neutral character. Secondly, it is intended to demonstrate that the identification of thisgroup of cases corresponds to a real dogmatic problem that must be addressed by the criminallaw under the subsumption analysis proper to the complicity scheme.

Este ar tículo aborda los obstáculos que enfrenta el derecho a la salud en el siste-ma internacional de resolución de controversias de inversiones extranjeras. Analiza jurispru-dencia relevante, argumentos normativos y pragmáticos y pretende que, tanto la protecciónal derecho a la salud como a la propiedad, tengan cabida. Desafía las actuales estrategiaspropuestas para fomentar la convivencia de ambos derechos, demostrando que ninguna deellas contribuirá de manera efectiva a mejorar la protección del derecho a la salud. Asimismo,explora nuevas medidas para enfrentar el problema, como la incorporación de la Organiza-ción Mundial de la Salud y la Corte Internacional de Justicia, y la alteración en la carga de laprueba mediante la aplicación del principio de precaución.

The article analyzes the difficulties that the Chilean penal system shows incontrolling its outcomes. It shows that the combination of a legal culture fixed with individ-ual judgements and an institutional design that maintains that focus and disperses decision-making powers between non-coordinated actors, might tend to produce such an effect. Thearticle offers a reconstruction of the administrative alternatives of control of penal outcomesthat can be respectful of the type of decision-making system that makes out criminal law.

This article highlights the subordination of the seller’s liability to the protectiongranted to the buyer in the context of the sale of someone else’s property. The rationale be-hind the solutions of the Chilean Civil Code is illustrated through a historical and compara-tive analysis, identifying two peculiar features which set it apart from other legal systems: theinexistence of a general system of a non domino acquisitions and the burden of the buyer todefend himself with all available means in order to seek responsability from the seller.

 In the context of the liberalization of their regulatory frameworks, most coun-tries in Latin America have incorporated the extended refugee definition of the 1984 Carta-gena Declaration in their domestic legislation. However, this particular definition has onlybeen applied in very few cases. In light of the mass displacement of Venezuelan migrants,and within a context of toughening migration policies, in general, and directed towards theVenezuelan population, in particular, it is necessary to discuss the possible application of the extended definition to this population. Without denying the importance of the politicalimplications of such application, this article addresses the challenges in conceptualizing itssituational elements from a legal perspective, specifically focusing on the massive violation ofhuman rights. To do so, we propose a conceptual framework for understanding this particu-lar situational element and its application to the Venezuelan case.
