This paper retrieves the importance of the classic concept of determinatio, as akey to restraining the expansive force of fundamental rights when judicially enforced. Thevery same nature of fundamental rights requires a prudential judgment so as to determinetheir legal scope, that is what they generally command, permit or prohibit. Such prudentialjudgement belongs to the political authority in the exercise of its legislative function, becauseit corresponds better with a discourse grounded on natural reasoning than with the artificialreasoning which is proper to the legal discourse. Thus, when the Judiciary protects funda-mental rights at the expenses of the legal order, either ignoring or contradicting statutorylaw, he practices a kind of reasoning that is not judicial in nature but political.

The purpose of the investigation is to determine the criteria for resolving theproblem of the statute of limitations for administrative infractions and sanctions based onthe principle of proportionality, when there is no general rule. It is stated that a uniformdeadline is not admissible, ignoring the seriousness of the infringement. In Case Nº 2261-2018, the Court of Appeals of Valdivia rejected an constitu-cional protection action because the dignity-threatening acts adduced by the appellant werebeing known in a criminal case about defamation. However, the appellant also reported aseries of other psychological harassment acts such as loitering, repeated calls and messages,which the Court did not address. In Chile, the victim cannot stop these acts through crimi-nal procedure, since what is known in Comparative Law as ‘Stalking’ has not been criminallyregulated. Thereby, the Court left the appellant unprotected against acts that alter the nor-mal development of daily life, violating constitutional rights.

We shall explore the narratives that led to the incorporation of the discharge ofdebts as a result of bankruptcy proceedings in the Anglo-Saxon world. The initial speech inEngland focused on creditor protection, so discharge was presented as an incentive for thedebtor’s cooperation for not being punished, alternatively, with the death penalty. The evolu-tion shows a paradigm shift, especially in the United States, based on humanitarian reasonsand the need to impulse economies conscient of the risks of trade. It is this second narrativethat was early received in Chile in the Bankruptcy Act of 1929, although it should be notedthat the model evidenced gaps and contradictions that, to date, have not been solved by thenational legislator.

A landmark in the treatment of retroactivity and acquired rights took place inChilean public law through the application of two Articles of the 1879 statute of secondaryand higher education. Courts fostered a true categorial debate on this subject, concerningboth favorable and restrictive decisions. These controversies show unknown records thatare important for understanding how these legal concepts were acknowledged by nine-teenth-century liberalism in Chilean Public Law.

The article analyzes the criminal justice policy foundations and the legal natureof the alternatives to imprisonment in Chile, by exploring the original legitimization argu-ments based on the special preventive ineffectiveness of prison sentences –especially those ofshort duration–; to current discourses based on contemporary criminal justice models, whichaim to legitimize alternatives as sanctions with rehabilitative content, which allow rational-izing the use of prison, and convey censure, constituting punitive consequences suitable forcrimes of medium to less gravity. This has necessarily gone in hand with substantial changesin its legal nature, moving from those initial foundations based on forgiveness, to the pres-ent, which seeks to recognize them the nature of punishment.

This paper analyses the effect of the buyer’s knowledge, before signing or clos-ing, about the falsity of one or more representations and warranties. It focuses on the case in which the parties do not address the issue in the contract. It holds that under Chilean law the actual knowledge by the buyer affects its ability to bring a claim for the breach of the representations and warranties.
