Resumo: Os consumidores em geral possuem uma dificuldade para administrar seus recursos financeiros na hora de efetuar transações ou de escolher uma melhor forma de quitar uma dívida cara, trocando por uma mais barata, mediante a falta de informações de cunho educacional financeiro que não tratada com seriedade. O objetivo deste estudo foi investigar a influência da educação financeira no consumo de bens e serviços, com foco no consumo dos créditos financeiros mais utilizados pelos brasileiros: empréstimo, cheque especial e cartão de crédito. Foi realizada uma pesquisa de natureza exploratório-descritiva com dados quantitativos realizados por meio de um questionário via internet, survey. Foram analisados o nível de endividamento por parte dos indivíduos, observando sua tendência de consciência nas decisões de suas transações. Os resultados observados apontaram dificuldades na gerência das finanças pessoas dos consumidores, influenciadas pela falta de educação e/ou alfabetização financeira dos indivíduos. Palavras-chave: Educação Financeira. The research aimed to analyze the complexity paradigm as the new transdisciplinary thinking in higher education, whose focus lies in the fragmentation of knowledge and cause-effect linearity. The methodology used was of a descriptive type where it was possible to analyze the teaching practice in terms of how to mediate knowledge for learning, the disciplinary paradigm and how its contents are presented in the day to day of the teaching exercise. The instruments used to carry out the study were the result of the experience obtained in a classroom at the graduate level based on participant observation, videos, audios, slides, essays. The results obtained reflect how Transdisciplinarity and Complexity are not inserted in Higher Education and are not part of an integral explanation of the objects and problems of study. Teachers, after their walk through the complexity paradigm, make visible the multiple tools Cognitive that support the complexus and the transdisciplinary. In conclusion, it can be stated that the teacher must be kept up to date by addressing problem situations in the field of frontier knowledge: the Complexus, Chaos, Fractals and propose new and better solutions to the problems in the educational field from systemic multireferential perspectives in an interdisciplinary and interdisciplinary way . Complexity allows us to redefine the position of reason in the response to the problems addressed, where the answers are posed from different approaches and integrate various relational systemic aspects when analyzing and conceptualizing all learning.

The main goal of this study is a reflection proposal about the ethical canon’s importance and validity in legal professional practice. This axiological perspective of Law impels revels the link and interrelation between two major fields in human science: Law and Ethics. Both complementary, equidistant, and without hierarchy among themselves; regardless of this, the daily practice has revealed that both haven’t been bounded taking different paths. The law history evidences by far, injustice, horror, backwardness and incivility; as well as, the history of the Ethics, is, on its own, that of the effusive speech to which all agree with more or less reasons; for which our professional actions usually do not honor, nor justice. That is precisely the dialectic that this study proposes, highlighting the deontological norms that allow the lawyer to satisfy the inalienable rights of his client, respecting the advocate and values strengthening upon society and human condition; Hence, honesty, probity, rectitude, loyalty, diligence and truthfulness are values that should adorn the neo century jurist’s formation.

The main objective of this paper is to do a comparative analysis between national and international doctrine and jurisprudence in relation to fundamental rights such as proportionality and private property against the establishment of precautionary measures in tax matters. The methodology used in the study was the application of an exploratory research, based on the analysis of documents, and materialized through comparative law. The instruments used were the systematic bibliographical review in order to integrate knowledge and in this way determine the particularities of each precept. In the results obtained, precautionary measures, from the perspective of this research, restrict the exercise of such essential principles as proportionality and rights such as private property. As a conclusion, it was determined that the power to initiate coercive processes that is invested in public administration is not questioned; however, instituting measures without observing constitutional principles and rights, results in an impact on and the detriment of the estate of the taxpayer.

This article aims to carry out a reflection and a conceptual clarification around notions that, in the current academic context, have become a key to university policy: excellence, quality, innovation, autonomy and social responsibility. Documents issued by international and national institutions on higher education have been analyzed and compared with the public policies implemented in Ecuador since 2010 for the development of this paper. Despite the fact that these policies sought to correct the shortcomings of the country’s higher education system, they have not managed to solve structural problems such as bureaucracy and the commodification of education. The text of this article represents an important effort for the analysis of college autonomy, in a context of tensions in the University-State and Market relationship, and also addresses the way in which the values mentioned above are found in the Ecuadorian institutions of higher education: excellence, quality, innovation, autonomy and social responsibility.

Throughout this research we will analyze certain historical milestones that will allow us to understand which are the reasons that cause a delay on non- criminal matters written processes in the new oral audience’s system, whether or not the oral system application will reduce the times set within the procedural system in court rooms. Additionally. We will conduct a value judgment that will allow us to evaluate advantages and disadvantages of this new system on Ecuadorian legislation, implemented in our Political Constitution since 1998 which let us to understand the regular procedures and summary courts whose purpose is the use of the verbal communication as due process guarante, effective judicial protection and legal security. The used methodology was documentary and analytical research, which investigated the current legislation and jurists doctrine to examine how they apply it in Ecuadorian court house, as well as, the procedural system correlating the application of guiding principles that regulate the verbal procedural justice system so that, the parties’ rights involved in a litigation cannot be violated. The research technique responds to the applied bibliographic compilation. As a result, the procedural system is mixed by the use of oral and written language that guarantee the due process in Ecuador’s court house.

In Ecuador a higher education access has been a political challenge to date for government. Despite governmental interventions to raise rankings on this field, Indigenous and Afro-descendant have had lower university enrollment rate. The research objective is driven to undergraduate university enrolment limitations in indigenous communities such as: Cotama, Guanansi and San José which are located in Otavalo Canton. The research methodology was quantitative, furthermore; a survey was applied. The results show that high school graduate students’ aspirations to get a college education have been reduce dramatically due to factors like the number of siblings, economic situation (low incomes), Ecuadorian’s colleges allocation system which students refuse, and low performance in National Exams by Higher Education (academic aptitude test), arranged by the National Secretary of Science and Technology (Senescyt) to get a public university admition. Finally, the results were analyzed by University staff members in order to find mechanisms that help high school undergraduate students to access higher education to make ensure better living conditions for these people.

The main objective of this research was to generate a concept of legal pluralism. A descriptive methodology consisting of collection of historical and bibliographic data, including the normative aspects, was employed. In that sense, the results show that legal pluralism is a phenomenon that has been historically the subject of debate in the Theory of Law, and that since its genesis, has gone through various stages of evolution. First, the concept was rejected through the strengthening of legal monism reflected in the state centralism of law. However, the concept is currently accepted by several States, mainly in Latin America, by virtue of its social realities, which have materialized the coexistence of various legal systems in the same territory. After the analysis of the data, it was concluded that the concept is still being developed by the doctrine. The current investigation is a contribution generates notions about several historical and evolutionary aspects of this institution, in a broad and a restricted sense, as well as its basic content from the perspective of sociology and legal anthropology.

This article analizes the socio- cultural dynamics of everyday life in Otavalo during early XIX century, at the time Alexander Von Humboldt visited this city. The article is composed by seven historic vignettes that ilustrate the most important social dynamics and phenomena during this era. The methodology is based on the cualitative analysis and codification of records of judicial processes. The data was collected at the Archivo Nacional de Ecuador y el Instituto Otavaleño de Antropología historic archives. These vignettes illustrate the complexity of Otavalo society in terms of colonial administration, ethnicity, religion, slavery, hacienda, everyday life, and social prestige. This information is useful to understand the evolution of local socio-cultural dynamics.
