The influence of minorities on state organizations and their protection are common features in constitutional orders, especially in those that emphasize the importance of the ethnic factor. Over the past decades, the revival of cultural and ethnic factors has led to the acknowledgment of the existence of culture-specific rules as elements of social identification. In Asia and Latin-America, one can spot the evolution of contemporary legal and social frameworks according to the concept of minority, leading to the recognition of the importance –and the existence– of cultural diversity

Resumen
One of the key factors to improve the competitiveness of a country is the development of public infrastructure, which promotes growth and allows its sustainability, but its execution must be planned and adapted to current and future needs in order to provide quality to a growing universe of users. The State-to-State contracting mechanism provides us with an additional alternative for the timely execution of public investment projects. It will be the responsibility of the State to correctly manage its use so that the solution does not become a problem.

This article aims to identify the release of land is a problem that can be avoided by the State, through effective project planning, as well as the establishment of the minimum necessary to proceed with the award. We will analyze how project planning is important for the development of different sectors of a country, and then determine how the status of PPP awards and land release is.

Resumen
The purpose of the present paper is to analyze the extension of the arbitration agreement to non-signatories, taking into account that in principle arbitration is characterized by the consensus of the parties who sign the arbitration agreement, to submit to this mechanism to resolve their disputes. However, the complexity of the contracts in their different stages (negotiation, celebration and execution) means that in reality there are more parties involved than those who sign it in writing, since they have expressed their consent in a different way.

Prevention, detection, management, and response to fraud inside an organization, in any sector, must be a practice adopted by industries to avoid direct and indirect losses. This article reviews studies that present statistics and allow us to reach conclusions based on fraud cases inside companies. Fraud prevention and detection measures, corporate risk management, due diligence, corruption prevention and real cases will be explained in this article, based on public research and from the author’s viewpoint from his personal experience.

Resumen
Starting from the identification of the importance of the discourses to understand social life and the analysis of employment policy, this article identifies the lines of discussion on the scope of labor rights or the policy of employment. Employment in the written press in Peru. In this way, based on an empirical study, it is revealed that these lines of discussion are not, strictly speaking, neutral, but rather obey certain ideas of economic and social policy that can guide the scope of labor legal norms, such as by example of flexibility-reduction of labor rights.

This article discusses the technical role of engineering professionals in ADR (Alternative Dispute Resolution Methods). MARCs, especially in the area of contracting works whether these public or private, may require the Engineer to act, among others, as a conciliator (extrajudicial or under the FIDIC model), mediator, friendly composer, expert, adjudicator (member of a Dispute Board or dispute resolution board), or arbitrator.

In the context of construction disputes under clause 20 of FIDIC contractual models, this article analyzes a very particular situation of conflict between the functions of a dispute boards and the powers of an emergency arbitrator and its implications in the contract.
