Colombia does not yet have an Open banking regulatory model; However, with Law 1955 of 2019, the National Government was empowered to create a regulatory sandbox -for a term of two years- that would allow evaluating and measuring the behavior of the markets and the level of financial innovation in the country, before adopting a definitive model. In use of the powers given by the legislator, Decree 1234 of 2020 was issued, in which the objectives, requirements and stages of operation of the controlled test space were generally set, as a tool to promote innovation in the provision of financial services and make it easier for supervisory and regulatory authorities to identify new financial developments. In this scenario, this article argues that, although the open banking rules in force in Colombia are transitory, the regulator cannot forget when defining the regulatory model that it will adopt that the main risks of its implementation lie in ensuring compliance with the rules regarding the protection of the rights to personal privacy, habeas data and personal data. In this sense, it is necessary to complement the personal data protection regime to fill some gaps related to the quality and responsibility of the financial and non-financial agents that participate in this new form of financial innovation.

This paper uses Social networks analysis (SNA) to study the civil-court case-law on intermediary liability in Argentina. It is a relatively recent contentious phenomenon, that was guided by claims that followed similar factual patterns and that presented Argentinean judges with new problems. Because there was no specific regulation, they had to resort to old constitutional principles on freedom of expression and general principles of civil law. Based on an original analysis of a dataset construed around these cases, the paper tells the story of that case-law, its evolution, the problems it solved and the ones that it left unanswered.

The use of ODR systems around the world has been shown as a viable solution to the congestion and judicial delay. These systems have a huge diversity depending on the societies in which they are implemented. From huge companies in the search of profit, to state-financed programs that search to put an end to judicial congestion. The purpose of this article is to study how the ODR systems around the world have been planned accordingly to the specific needs of each society, to evaluate the success of each system and, finally, to present an implementation proposal accordingly to the specific needs of Colombia.

Public institutions are constantly affected by cyber incidents capable of affecting critical infrastructure and the exercise of citizens’ rights. Informing the citizens of every cyber incident would be unfeasible, therefore a standard is proposed to decide in which cases a cyber incident in a public institution must be communicated to society, and how they should be made aware in order to comply with the right to information. For this reason, the Mexican legal framework regarding cybersecurity and the right to information is presented, and thus sustaining the argument against considering public attribution of cyberattacks as a substitute to the obligation to inform society. Finally, emblematic cyber incidents in Mexican public institutions are analyzed according to the proposed standard.

The study analyzes the relevant market categories and structural pluralism, understanding as such the set of mechanisms that, without affecting the content, allow knowing the diversity of messages and controlling the concentration of the media. In the Chilean case, this function corresponds to the National Economic Prosecutor's Office (FNE), which receives information regarding the change of ownership of any media outlet, and whose favorable report is necessary for operations involving media holders of a concession. (radio and television). In this context, it should be noted that the scarcity of the radioelectric spectrum, which is the most powerful reason for government intervention, has nevertheless been altered by the digitalization of television and radio and by the development of the Internet. This study raises some concerns regarding the relevant market definition used by the FNE. The data concludes that this assessment should also consider the consumption of digital media, and not only traditional media outlets.

The smart contracts phenomenon arises as a new step in electronic contracts. This work researches the semantic complexities of drafting legal agreements in increasingly digitalized environments. The article aims to identify theoretical limits incorporating programming language in drafting agreements by studying the level of rationality in contractual terms and legal reasoning. The language of code is highly rational, but the pervasiveness of rationality within the legal language may vary according to what contract´s categories and legal reasoning are being adhered to.

En el sector educativo las habilidades socioemocionales (HSE) son capacidades de gestión de emociones y conductas que benefician las relaciones sociales y el logro de objetivos educativos. Contar con ellas puede favorecer la salud mental (SM) y el bienestar en los profesores de educación superior quienes inciden en la formación de futuros profesionistas, por tal motivo se considera fundamental contar con instrumentos que evalúen estos aspectos de manera confiable. El objetivo fue realizar el análisis de validez de constructo del Inventario de Habilidades Socioemocionales y Salud Mental para Profesores “IHSM-P” de Educación Superior. La muestra se integró por 282 profesores y el análisis de validez fue mediante el análisis factorial exploratorio. La validez de constructo se efectuó mediante la técnica de análisis factorial exploratorio (AFE) y la verificación de la pertinencia de los datos fue mediante la prueba de Kaiser Meyer Olkin (KMO) y la esfericidad de Barlett. Los resultados mostraron correspondencia con la propuesta teórica al reconocerse seis factores, integrándose el 60% de ítems propuestos. La confiabilidad fue óptima (Alfa de Cronbach: 0.907), y pertinente para los diferentes factores encontrados (Alfa de Cronbach >0.70). Se concluye que el IHSM-P es un instrumento que cuenta con adecuadas características psicométricas.

El presente trabajo tuvo como finalidad analizar el comportamiento del marketing y la gestión responsable en Ecuador; como una reflexión de la importancia que tiene contrastar con hechos la información recibida a través del marketing en donde puede estar implícito el discurso posverdadero, para lo cual se expone prácticas de greenwashing. Se utilizó un nivel de investigación de tipo descriptivo y como técnica de investigación para la recolección de datos e información relevante la bibliográfica o documental que respalda la revisión teórica y los resultados presentados. Como principal conclusión se determinó que en el mundo empresarial el discurso posverdadero puede estar presente al momento de comunicar a través de una publicidad engañosa sobre la gestión social y ambiental que una empresa u organización supuestamente realiza, siendo esta práctica conocida como greenwashing o lavado verde.

El Objetivo de la investigación fue determinar de qué manera influye el Programa Pensión 65 en la calidad de vida de los usuarios de la provincia de Chupaca 2020 – 2021. El diseño de la investigación fue no experimental porque no se manipulará variables. Siendo un estudio descriptivo, con corte transversal se realizó en un tiempo determinado (2020-2021). La población que estudiamos estuvo compuesta por 1638 usuarios y una muestra de 287 usuarios por criterio de exclusión e inclusión. Utilizamos la encuesta como técnica luego dos instrumentos, dos cuestionarios: primero con contestación dicotómica para Programa P65, segundo cuestionario con escala de varias contestaciones politómica para calidad de vida. Validamos nuestro instrumento por juicio de Expertos, para analizar nuestra relación de variables aplicamos el coeficiente de Rho de Spearman = .050. En nuestros resultados llegamos a la conclusión, que la variable Pensión 65 influye en el bienestar de vida a través de la seguridad económica en los usuarios pertenecientes a la provincia de Chupaca – Junín 2020 - 2021 se presenta que el grado de significatividad, p <0.05 y coeficiente Rho de Spearman =  .660 con una varianza del Programa P65 y bienestar de vida con una influencia en 0,01 %.

The academic procrastination is leaving study-related tasks for a later time that never comes. This article aimed to determine the information that existed on academic procrastination in the period from 2010 to 2021. Journals such as: Revista Iberoamericana de Psicología: Ciencia y Tecnología, Anales de Psicología, Global Journal of Educational Research, Psychological Review, Revista Electrónica Interuniversitaria de Formación del Profesorado, Revista Complutense de Educación, British Journal of Educational Psychology, Researchgate.net, Horizonte de la Ciencia Revista Científica, SciELO, were used with the descriptors procrastination, academic procrastination, procrastination, academic procrastination and postponement of activities; such research was conducted in Spanish and its relative in English. The review showed that academic procrastination occurred in a higher percentage within the university student population. It was concluded that this procrastination does not only occur in a specific gender, but it occurred in both, female and male, and it had nothing to do if the grades are high or low, procrastination occurs in an equivalent way.
