Resumen
Se analizaron las diferencias en el bienestar y la salud laboral en la población trabajadora en las dos últimas Encuestas de Condiciones de Trabajo, coincidentes con el periodo previo de crisis económica (2008) y más agudo (2012). Las hipótesis se probaron mediante comparación de medias. Los resultados mostraron que los niveles de bienestar y salud laboral empeoraron significativamente en 2012 respecto a 2008 en todas las personas ocupadas, afectando especialmente al sector servicios. Adicionalmente, encontramos diferencias entre hombres y mujeres en salud laboral tanto a nivel general como de forma específica en el sector servicios. Por otro lado, y a pesar de que los trabajadores extranjeros percibieron menor satisfacción y mayor inseguridad laboral que los trabajadores españoles, no experimentaron un empeoramiento del bienestar y la salud laboral superior al de los trabajadores españoles durante la crisis.

Resumen
The aim of this study was to analyze trends in cyberbullying research conducted in Spain by researchers in Spain or together with other countries in the decade 2007-2016, through bibliometric analysis of Spanish scientific production. The sample to be analyzed constituted of 178 papers. The results indicated a progressive growth of productivity levels, with 2015 being the most prolific year of that decade. The highest number of articles focuses on high school students of both sexes analogously to what has been the study of bullying. Most of the articles were published in multidisciplinary journals, and were signed by three or fewer authors. They showed a clear predominance of non-experimental methodology, with the use of questionnaires or other types of instruments. There was a lack of research on the contexts within which cyberbullying occurs and research on university students.

El II Congreso Internacional sobre Universidad e Inclusión tuvo como eje central el diseño universal del aprendizaje y estaba dirigido a científicos de cualquier entidad asociada al ámbito universitario que hubiesen desarrollado proyectos de investigación y trabajos relacionados con este campo, desde una perspectiva nacional e internacional. Se podían presentar investigaciones, solo en forma de comunicaciones orales, que supusieran un avance significativo en la atención a las personas con discapacidad en las universidades, en cualquiera de los sectores académicos en los que se desarrolla la acción universitaria. Durante el congreso se presentaron 31 comunicaciones, que se incluyeron en una de las cuatro áreas de interés en relación con la atención a la discapacidad: Diseño universal del aprendizaje; Acceso a la universidad, acogida y seguimiento; Acceso a prácticas y a empresas – Inclusión laboral, y Salud mental y universidad.

Resumen
Since the nineties the international arena has born witness to a number of attempts to join the forces against poverty to the defense of human rights. Such a task has been founded so far on programmatic or soft law instruments. The Inter-American Court gave a twist to this trend with its ruling in the Case Workers of the Hacienda Brasil Verde vs. Brazil, because it established the juridification of the link between poverty and human rights. The main objective of this research is to unveil the importance of this step in the context of the efforts to eradicate poverty. With this objective in mind, we analyze how the Inter-American Court accomplishes this construction that culminates by determining state responsibility for violation of human rights in relation to the principle of equality and non-discrimination by economic position, together with the consequences of this reasoning, especially for the identification of new judicial standards in the struggle against poverty.

Vulnerability of Special Agreements Signed by Non- State Armed Groups in Non-International Conflicts

Resumen
International law has recognized the existence and legal force of special agreements signed by non-state armed groups —NSAG — in the context of non-international armed conflicts -NIAC -. Nevertheless, considering the poor development of this area in International Law, praxis evidences that national governments bring a different legal treatment to those instruments. In consequence, there is not a clear path to oblige the parties to fulfill what they internationally have agreed to. This paper aims to establish the vulnerability of special agreements as result of the lack of protection from international law. As main discussion points, it is approached: a) the legal capacity of non-state actors, b) the legal treatment that international law confers to these legal instruments and c) review of some cases.

Resumen
This paper analyses the interrelation between climate change, businesses and human rights. The main objective is to discern the climate obligations of corporations, which should be included in the international climate change regime in order to share binding greenhouse gas emission reduction targets with States and ensure the necessary conditions for the enjoyment of human rights through the implementation of effective and comprehensive due diligence processes. To this end, the paper examines some soft law instruments that contain or clarify climate standards applicable to business activities or recognize the role of corporations in addressing climate change.

This paper highlights the importance of the establishment of a legal term that recognizes the climate change displaced people in the framework of International Law. Transborder migrations caused by the impacts of anthropogenic climate change are a reality that require recognition, rather than doctrinal, legal, in the field of International Law. The variety of doctrinal meanings and categories (not legally binding) shows up the lack of focus of the problem and the legal gaps to face. Currently there is no consensus on a legal and univocal concept that defines people who are displaced by climate change, its legal status its undetermined, as well as the applicable normative instrument that provides the necessary international legal protection, which assures migrants a planned relocation outside their home countries and that guarantees respect for their rights. The legal consequences of the lack of legal status are reflected when analyzing the case of Kiribati’s citizen, Mr. Ioane Teitota, who, before the New Zealand Courts, requested refugee status due to the difficulties that he faced at his country with respect to the impacts of climate change, particularly in the face of sea level rise.

Resumen
This paper analyzes the relationships between the transnational legal plane and national and international rights, with special emphasis on the regulation of the hydrocarbon sector with the aim of understanding the transformations of the emergence of transnational law and the challenges involved in socialization and the democracy of the production of the right and the inequality between the different subjects that participate. It consists of three parts: the first analyzes the “denationalization” of transnational law and its effects; the second, the “materialization” and its effect on the public / private distinction; the last one, the challenges of transnational law in terms of socialization, democracy and equity. The central hypothesis is that the processes of “denationalization” of regulation in the energy sector tends to produce a new logic in the production of law both nationally and globally, erasing the distinction between public and private.

The Inter-American Court of Human Rights (IAC HR) changes over time. In the 1980s, the main cases were submitted to Advisory Opinion that moves towards a more Decisions and judgements in a interventional way at the Court Caselaw in 90´s. Judicature and the Presidency of Pedro Nikken allows a company to have the freedom of decision during the period, as their own laws while preparing for justice. The historical context of the rise of human rights and an idea of progressive development is the most qualified background of the proposal of “Court Nikken” that critically analyzes the expansion of the contentious jurisdiction IAC HR. The advisory companies and contentious cases judged by the IAC HR have demonstrated stages of development and formation of the Court’s own identity.

Resumen
The double crisis of the World Trade Organization demonstrates its inability to fulfill the functions she has to achieve by virtue of its constitutive statute. The institutional blockage of its functioning is affecting its first mission: the efficient administration of the international commercial agreements concluded by its member States. The World Trade Organization has also failed to serve as forum for the multilateral commercial negotiations between its members. The crisis origins are complex and the possible ways to go through it are not sufficient to put an end to its impasse.
