It is a qua-litative-interpretative research based on hermeneutics, on the thematic axes involved in the study. Among the purposes of the research is to develop the importance and meaning that human capital has towards organizational growth. Unveil laws, decrees and gazettes related to labor legality, with the intention that human capital knows its rights before the employer; in order to avoid the exploitation of man towards man. And finally, highlight the complexity of both human capital and its legality in the workplace, as a panacea towards the pursuit of management objectives, with the sole intention of enhancing competitiveness, innovation and especially social responsibility, to dignify the work of the fundamental matter in organizations as it is, human capital.

This study reflects the processes of linking higher education institutions with their environment or society where they maintain an economic, social, sector or educational focus is maintained and is governed by the approach policies, laws or regulations to university level. To carry out this research, a comparison was made of the internal situation of Ecuador, with other countries in Latin America and Europe in higher education institutions, therefore, it is sought to know if the legal technical founda-tions contribute positively of or negatively to the learning process, through a descriptive documentary review. This was done through electronic search in books, theses, magazines, papers and publica-tions of congresses in order to the topic of research since its inception and relevant and updated information. One of the conclusive is that a higher education institution intends to fully comply with the regulations, whether internal or external, in relation to the relationship with society, thus seeking bidirectional learning, that is, both teachers and students, as well as transmitting knowledge to a be-neficiary community or sector.

In all the educational systems of the world strategies are proposed to minimize conflicts and violence in schools and colleges, thus trying to resolve serious confrontations between students and teachers with teachers, considering this a violent generation. These value-based practices are intended to model the violent characters of the students through a practice of mutual coexistence, dialogue and respect, avoiding discrepancies due to racial, religious, political, social, economic or cultural conflicts. This aggressive behavior almost reaches barbarism due to the inability to live together in peace, with values of solidarity, harmony, cooperation, equity and non-discrimination. Unfortunately, society has become accustomed to violence in the world, so mandatory changes have to be made. Although the violent behavior of the students is initially generated in the family, generating problematic and malad-justed students, it is necessary to carry out the necessary transformations in the training of these that allow them to relate to the educational institution through participation and integration in that field. The hope and faith that these changes will take place in future student generations is a desire that the entire world society hopes for the consolidation of the peace of humanity.
