To distinguish between an administrative and jurisdictional function, we will take as a starting point the residual criterion, as well as its function of protecting the general interests. In this way, those cases that cannot be classified as jurisdictional or legislative will be administrative in nature.

Resumen
Urban territorial planning and its instruments have undergone several reforms recently. The increase in citizen participation, the incorporation of the objective image and the inclusion of minimum standards in the creation of these instruments, are just some of the modifications introduced by the legislation in order to contribute to the transparency of the land market. In this context, this article focuses on the analysis of Article 28 decies of the General Law of Urban Planning and Construction, which is the cornerstone of the new way of planning territorially in Chile. This paper deals in detail with each new standard, based on recent legislation and the current National Urban Development Policy.

This paper addresses the environmental notion in the new Constitution project for Chile of 2018 (Boletin 11617-07), as well the citizen dialogue prior to the project. The objective is to determine how far such protection extends and how much of the Ecuador and Bolivia “Andean Environmental Constitutionalism” is present in that reform proposal for Chile.

Resumen
This article faces the present and future regulation of the recognition and enforcement of judicial resolutions in the matter of international child abduction in the European Union. Specific subject which motivated a singular –and privileged– regime of recognition and enforcement, different from the general regime in the matter of parental responsibility. Recently, the applicable instrument, the 2201/2003 Regulation (Brussels IIa Regulation), has suffered an important recast which has ended with the promulgation of a new Regulation, the 2019/1111 Regulation. Therefore, in this work we will deal with the complex interaction between the legal sources, both of EU sources and international conventions, notably the 1980 Hague Convention, analysing not only the present regimen but also the abovementioned modifications. This analysis will allow us to conclude with some of the actual and future tendencies of the Private International Law third sector in the process of construction of a free area of freedom, security and justice in the EU.

The study will analyze the jurisprudence of the Supreme Court about with the non-renewal of contract employments, for this purpose, the jurisprudential precedents from 2015 to 2019, will be considered, evidencing the shortcomings and changes in the interpretative exercise of the judiciary.

Resumen
Contemporary society demands innovation in the teaching of the Law. In that sense, the pedagogical methodology based on competences can be a useful instrument since it aims to train students for professional competence in a changing world, so that the link between university education and reality is the main objective of the learning process and is carried out taking into account that the evaluation process, programming and planning are related to each other and must occur in parallel. However, technique, theory and teaching methodology are not enough for a better world, if there is no democratic context and participation of educational actors.

Resumen
Como equipo editorial de la Revista Justicia & Derecho de la Universidad Autónoma de Chile, nos complace presentar el primer volumen correspondiente al año 2020 que nos sitúa en una nueva etapa de fortalecimiento y posicionamiento de este esfuerzo científico que nos compromete a entregar a la comunidad jurídica nacional e internacional nuevos trabajos de relevancia jurídica.
Hemos realizado lo anterior en pleno proceso de migración de nuestro sitio electrónico actual hacia una plataforma institucional que reunirá a todas las revistas científicas de nuestra Universidad a cargo de la Vicerrectoría de Investigación y Postgrados. Con ello se mejorarán los controles de calidad vigentes lo que significa un nuevo paso de excelencia para seguir sumando indexaciones en las principales bases de datos, índices o repertorios de consulta mundial.
Este volumen ha logrado reunir ocho trabajos de investigación y reflexión científico-jurídicos, dos comentarios de sentencia y una recensión de una obra cuyo autor, además, nos ha ofrecido uno de los artículos de doctrina que se presentan. Como es habitual, la colaboración de profesores extranjeros que nos han presentado los frutos de su trabajo de investigación marca presencia con tres colaboraciones destacadas.

Resumen
It is fundamental to identify the framework and measures taken to address the Global Financial Crisis and, therefore, prevent a future crisis. This is the primary purpose of the financial architecture. It is arguable that the financial architecture was proper to mitigate the consequences of the Global Financial Crisis. On the other hand, this architecture is not sufficient to address the challenges of the global finance. The main concern in the global finance is to avoid future crisis. The existing infrastructure will not avoid a future crisis. It is necessary to take steps for a proper regulation and policies considering resilience for banking sector and financial system in a macro landscape. Financial markets are not an end in themselves but mean: they are supposed to perform certain vital functions that enable the real economy to be more productive.

Resumen
International investment flows have grown steadily since 1990, among a global acceptance of their benefits. However, this situation is changing sharply. Globalization and foreign investment are under siege, and a more cautious approach to both of them is ascertainable in many places. Among other consequences, this leads to the enactment of more restrictive regulations towards them.
The European Union is an economically integrated space, extremely open to foreign investment. Since 2009, the Common Commercial Policy embodies foreign direct investment. Nevertheless, the consolidation of this new policy coexists with the development of screening mechanisms of foreign investment on national security grounds. Some European countries have developed them, and the European Union, itself, also enacted a Regulation on this topic in March 2019.
The Covid-19 pandemic, with its devastating economic and social effects, introduces an additional element of tension in this topic in the eu. The need to preserve strategic sectors of the European economy collides with the principle of free movement of foreign investment that has characterized the Union since its inception, raising doubts and premonitions about the future to come on this area… A future, that, perhaps, is already here.
