The different areas of competence both by reason of the matter –to which there quests for precautionary measures (fundamental rights, prevention of occupational risks, etc.)-, and by reason of the territorial scope of their application, are the central nucleus of the judgment. The aging of the population is a demographic problem of a structural character which affects in a large or small measure all members of the European Union. In Spain, this problem will enlarge within the next 10 years with the retirement of former baby boom generation, which has put in doubt the viability of the social security economic distribution, designed in the years between 1963-1966, when the state of affairs of Spain and their protective needs were very distinct to the current existing ones. Furthermore, with transitory character, Spain has been immersed in an economic crisis since 2006, due to the effects of the economic globalization in the financial field especially by the fall in the real estate sector caused by the disproportionate rise in the prices of this secondary sector. This fact has provoked a decline in contributors which has raised a necessary awareness in political parties that requires a sustainable modification in respect to public pension payments. From the year 2011 reforms have been introduced in relation to public pensions, so the delay in retirement age, the active aging, the regulation of the sustainability factor, the revaluation indicator and recommendation towards private social pension plans as a complement of public pensions, are aiming to secure the constitutional principle of economic sufficiency for citizens.

The work analyzes and assesses the current System of Vocational Training for Employment in Spain, from a legal point of view. The analysis of regulations advances from the first agreements highlighting the importance of Vocational Training for Employment and that they contemplate the bases , to the various additions and developments that have occurred over time, with special incidence on the current situation COVID, which has led to a paralysis of the Training System, and adaptation of it through extraordinary measures to reactivate the Professional Training courses for Employment in person.

Two recent judgments of the Plenary of the Social Chamber of the Supreme Court dated June 17 and 18, 2020 have unified doctrine in relation to the consequences of the appreciation of law fraud or abuse in temporary hiring in State Mercantile Societies. Until now, the workers who were in this situation were considered permanent employees of these companies framed within the common labor regime. However, these two judgments give an important jurisprudential turn in this regard, changing the criterion followed so far by our High Court, considering the workers who are within this group as "permanent non-fixed" instead of permanent staff.

The present paper focuses in the study and analysis of the recently approved minimum living wage through the Royal Decree-Law 20/2020, on May 29. The first part is a brief review of the main reasons that drove our government to establish this new non-contributory presentation of our Social Security system. This way, we establish the original framework where we expose the initial disadvantaged situation from Spain in terms of poverty and exclusion. The second part features some of the critics and challenges that the minimum living wage faces. Challenges that need to be addressed in order to succeed in the reduction of the poverty level in Spain.
