The constitutional notion of “inclusive secularity” puts forward a rupture with the negative dimension that has normally characterized secularist points of view. This demands the rethinking of the notion of secular State. The old obsession with a separation that kept a cordon sanitaire between public authorities and the religious factor, yields to a cooperation that acknowledges religion as a factor as positive and worthy of support as culture or sport. Constitutional Court’s Judgments such as 46/2001 and 34/2011 put into practice the constitutional mandate that requires a cooperation that reflects the Spanish society’s beliefs, discarding a mere equal treatment in dealing with religious communities.

In this article, the author explores the four distinct models on religious liberty that can be distinguished from the American founding era: Puritan, Evangelical, Enlightenment, and Civic Republican models. Exponents of these four models often found common cause and used common language, particularly during the constitutional convention and ratification debates. Yet each group offered its own distinct teachings on religious liberty and had its own preferences for their implementation in constitutional law. Together, these groups held up the four corners of a wide canopy of opinion about religious liberty in eighteenth-century America.

This paper departs from the consideration of the Inter-American system of human rights as a legal scenario resistant to religious disputes. The study of cases on religious freedom will offer a general approach to the contributions made by both the Commission and the Court to defend freedom of religion. This knowledge could be useful to solve eventual future religious problems in a pluralistic society.

The creation and interpretation of symbols is one of the few activities that could be properly defined metasocials and are, at the same time, metabiological. Still, the fate of symbols —and especially of religious ones— appears nowadays to be clearly in danger. As a matter of fact, someone would permanently remove them from the public space, imagining a city composed exclusively of lay and therefore neutral spaces. Examining the difference between symbol and sign, places and (non) places secularism and laicism, the present study intends to criticize the iconoclastic posture assumed by a part of the doctrine. In order to safeguard religious symbols from an unfair exile and justify their presence in public places.

Technological advances have facilitated the processing of personal data by individuals, which may pose a greater risk for the protection of privacy. This study analyzes the domestic exception contemplated in normative texts, community and national, and the consequent exclusion of personal and domestic activities from the field of application of data protection regulations. It offers the response of the courts and the AEPD to the most conflicting cases.
