Criminal systems operate by altering the motivational mechanisms that explain individuals’ behavior. To do that, the sanctioning device seems to play a major role. According to a standardly utilitarian assumption, an increment in sanction efficacy is usually followed by a proportional increment in normative compliance. In the present paper, however, I will try to show not only that the correlation between these two factors is more complex than the assumption admits, but also that a deeper understanding of human motivations provides greater insight into some aspects of our criminal systems’ justice and legitimacy that may have an impact on their moral justification. Arguing from a set of postulates that conceive our criminal systems as guaranteeing the preconditions of (deliberative) democracy, my ultimate aim will be to design a comprehensive evaluative model of the way they function grounded on the notion of consent.

The Catholic Church is one of the most important actors in the field of human rights in the international arena. Nevertheless, the acceptance of such rights in the Pontifical Magisterium has had its ups and downs that are reflected in the vatican documents. The aim of this work, departing from a linguistic analysis, is to make an approach to the causes that explain the divergence and subsequent convergence of the matter, as well as its current state.

As a comment on Francesco Viola’s work about the future of Law and his insistence in the necessity of legal adjudication takes into account the circumstances of the particular case, I shall intend to show the reasons that led to a view of rules as general and abstract norms, almost algorithmically applicable to individual cases. After I shall refer to the well-known crisis that this idea generated and the introduction of the principles in the law’s image. Arguing, as conclusion, that this image of Law as a two storey building (with two floors one for rules, another for principles is not adequate and it should be substituted with the image of a single storey building (with only the ground floor), in where rules and defeaters live together, defeaters being something like gargoyles, that can modify, alter and make more accurate the rules through allowing the use of moral considerations and moral argument.

The era in which we are living could be defined as the era of global migration. Masses of inividuals – in the most part coming from countries tormented by hunger, epidemics or wars – are crossing the sea, the ocean or the desert, in search of safer shores where to find shelter and hospitality. From their part, Western people feel the strong pressure of this massive exodus, evaluate with increasing concern the consequences – for economy and public order –, and basically divide themselves into two different groups: the few who want to offer hospitality and the many who would rather raise higher and higher walls to segregate misery and despair on the other side of a frontier. Where does the distrust of the foreigner come from? What are the psychological and sociological mechanisms that favor its diffusion? Could we find a philosophical guideline to address such problems? Inspired by such questions, the present essay detect in the duty of hospitality the original and foundational position of philosophy of law.

The possibility of introducing some kind of request and grant of forgiveness as a dimension of reparation and reconciliation has played a relevant role in the processes of political transition towards democracy. This paper deals with our common vision of forgiveness as an exclusively Christian heritage. To do this, it considers the place of forgiveness, if any, in the classical Greek and Latin philosophical tradition. Second, it is about seeking a secular concept of forgiveness after the appearance of Christianity. Unlike the pre-Christian concept, in this case it will be necessary to find not only someone who has formulated it, but also has done so with characters other than the Christian sense of forgiveness.
