Resumen
The actions of the Russian armed forces in Ukrainian territory have highlighted the importance of having effective legal and judicial response mechanisms to deal with certain situations that could fall within the concept of the crime of aggression contained in article 8 bis of the Rome Statute. Spain, however, lacks a criminal provision that covers all the elements of this crime. Its inclusion in our national legislation would avoid impunity for this type of conduct, would favor the complementarity of the International Criminal Court in relation to national jurisdictions and would reinforce Spain's commitment to the safeguarding of Human Rights.

Resumen
Accepting that the typical structure of art. 305.1 CP does not fit the paradigm of “domain crimes”, it is suggested to convert the purpose of redistribution of wealth, typical of the tax systems of democratic and social States -such as the one designed by our Constitution- in the reason that legitimizes the criminal intervention. This legitimizing reason allows to configure the crime contained in art. 305.1 CP as a crime of infraction of duty, in which the performance of the typical conduct (fraud in its different forms) meets the type without it being necessary to prove the damage to the Public Treasury (as a naturalistic result) and allows explaining the introduction of a minimum limit to the amount defrauded and the mitigating and aggravating factors specific to the amount. In addition, this legitimating reason also serves to limit the Ius puniendi, thereby overcoming the theoretical objections to the crimes of breach of duty in relation to the tax crime.

Resumen
The ratio legis of the 2015 reform requires a restrictive interpretation of the criminal exclusion of public business entities. Based on it, the administrative concept of “public powers” and the UE concept of “services of general interest” allow progress towards a relatively autonomous penal concept in which to focus discriminatory treatment between the various entities of the institutional public sector. Thus, the exercise of “administrative powers” will define the entities that will be excluded from criminal liability. On the other hand, the UE concept of "service of general interest" will exclude from the limited liability regime those public commercial companies that only carry out economic activities. The rest would be relegated to the general RPPJ regime.

Resumen
The aim of this research was to identify gratitude profiles, basic psychological needs in relation with resilience of non-traditional students adults worker. This study was cross-sectional, descriptive, non-experimental in design and a cluster analysis was used. A total 114 students from a local university answered 3 instruments to evaluate these variables. This study reports 4 profiles and showed that only one significantly differs in resilience from the others, featuring high levels of gratitude and psychological needs. Profiles that are underperforming in the variables obtained lower resilience. One of them, equivalent to 10.5% of the students, also reports a lower need for autonomy. This study suggests that interventions must be focused on young students to strengthen their need for autonomy and resilience.

The goal of this study was the validation of an instrument to assess co-responsibility strategies and family agreement. Considering positive parenting as framework, communication, conflict negotiation and emotions constituted central axes. 220 parents completed an 18 Likert-item instrument. The reliability and validity of the instrument were analyzed: internal consistency, differential items functioning and the analysis of measurement invariance. A 3-factor structure was revealed: beliefs about motherhood and fatherhood, emotional communication and family agreement. Configurational invariance was maintained but not metric and scalar ones. Gender, educational level and labor occupation seemed to determine the parenting competence to be mother and father.

Resumen
Before referring to educational innovation, we need to determine what we mean by perfecting both the educational act and the growth process of the people involved. Inspired by the way of understanding personal development of Leonardo Polo and Erik Erikson, among other authors, we analyse the anthropological and psychological requirements which are necessary for novelty to emerge both in each educational act and in the actors involved in it. We find that novelty emerges within each educational act when competence is placed at the service of the transformation of the world for the sake of interpersonal encounter.

Resumen
This study focuses on e-assessment of oral presentation competence using technology resources in a model that combines project-based learning and flipped learning. This study uses a digital rubric to assess oral presentation competence in different situations of progressive assessment for 99 preservice teachers, situations in which participation was either optional or compulsory. Findings show that the digital rubric used at various times is a methodology and a technology that facilitates the feedback process and dialogue between teachers and students about the assessment criteria. The results support future decisions for methodological design of formative assessment appropriate to online learning environments.
