Resumen
The use of technology brings with it the use of robots and artificial intelligence in various areas of the production of goods and the provision of services, which is generalized labor automation and the fading of labor rights of people, so that It is necessary to rethink professional and legal expectations for the future. The following objectives are aimed at: addressing the reality and regulations of the right to work that is aimed at governing labor relations only between people; expose some data on labor automation and the rethinking that must be done to face the construction of a new way of educating for a future not far away; to approach the interaction of the human being, particularly the worker with the technology, and in a general way, of this with the people. Also, reflect on when people resent any impact on their rights for the use of technology without the legislation includes provisions to protect and guarantee them. To achieve these objectives, a survey of information in bibliographic and digital sources is proposed to reinforce the author’s position on the current and future context of the right to work, the dissemination of labor automation and, as a corollary, what is considered to be transcendence, the visualization of rights of affectation due to the use of technology as human rights.

Resumen
La figura del capital constitutivo contenida en la Ley del SeguroSocial reviste tal importancia como un medio para asegurar la atencióndel trabajador y sus beneficiarios en caso de riesgo de trabajo o enfermedad general, que garantice las prestaciones en especie y en dineroa que tienen derecho a pesar del incumplimiento de aseguramiento, paraposteriormente ejercer su cobro sobre el patrón omiso. El objetivo delpresente documento es analizar dicha figura mediante una investigacióndocumental descriptiva que busca crear conciencia entre patrones sobrela conveniencia de asegurar a sus trabajadores. Concluimos que si bien lafigura del capital constitutivo podría ser considerara como un medio coactivo de aseguramiento, se trata más bien de una figura de resarcimiento del daño

Resumen
Social rights are ecognized by the contemporary global doctrine by its autonomy and direct justiciability. Notwithstanding, in light of various failures in regional and national courts, positive effects of social rights’ judicialization are not entirely convincing. As for the Mexican constitutional system, there is an ongoing construction of a social rights demosprudence. To achieve this, the Mexican constitutional approach takes guidelines from the international human rights law and regional trends on social rights. Within this framework, the article emphasizes that the Mexican jurisprudence of social rights has ups and downs, advances and setbacks, since there are progressive lines and some others denote ambiguous and restrictive interpretation.

El artículo tiene como objetivo proponer que se reconozca al Estado mexicano como un Estado social de derecho. Para ello, es menester acercarnos a los conceptos de Estado social de derecho y de Estado de bienestar. El establecer los elementos definitorios de los Estados de este tipo nos permite contrastar éstos con las características del Estado mexicano y reconocer que no contamos con el marco jurídico ni con políticas económicas que nos permitan sostener que se cuenta con bases jurídicas de un Estado social o de bienestar. Finalmente, en un tercer apartado realizamos una propuesta para “enmendar el camino” y comenzar la construcción de un verdadero Estado social, con el objetivo de lograr justicia social.

The Mexican Rule of Law requires establishing a legal con¬cept that describe in a substantial way the “collaborative economies” in order to encourage true collaborative economies based on the common good, which help in the solution of social conflicts. This would allow to classify, systematize and regulate the activities of online companies that do not contain elements of the “collaborative economy” in such a way that they respond to their operational practices. To demonstrate this hypothesis, the present paper first provided a theoretical framework to help identify the elements that constitute a co¬llaborative economy of those who do not; as a second step, it chose to develop a methodology that allowed to show the classification of the platforms based on the developed activity; what allowed the third step, to elaborate a regulation proposal in Mexico, and finally the importance of these reforms was justified from the current social and economic dimension in the country.

Resumen
The Constitutional Court at the sentence T-629 of 2010, has recognized the need to correct the current scenario of discrimination and violation of the fundamental rights of sex workers, through the creation of a normative framework that establishes the conditions in which should be provided sexual services, as well as the determination of the rights of sex workers without the date of the Congress, it has not remedied the lack of legislation in the matter. Therefore, the implications and needs of a legal framework that allow the recognition of the labor rights of this population are analyzed in this paper.
