The paper analyses the existing differences in the regulation of termination of the contract of employment for domestic workers in relation with the common regulation provided in the Estatuto de los Trabajadores. For this purpose, ILO Conventions and Recommendations related to domestic workers are studied in the first place. The paper moves afterwards to the description of the Spanish legal regulation, and finally studies the differences in the regulation of the termination of the contract of employment (including not only the legitimate reasons to dismiss but also the legal effects of such dismissals) The need of promoting a decent work to domestic employees leads to recognize a protective regime for them in case of the termination of their contracts, as they are a particular group of vulnerable workers as ILO has repeatedly declared.

In an activity in which women represent more than 90% of workers, it is undeniable the need to design policy to adopt gender mainstreaming in social protection interventions targeting domestic workers. This paper analyses the Spanish Social Security system of  the domestic work from a gender mainstreaming. This perspective is essential because the formulation of the Social Security has been a significant factor in generating the gender gap that has characterized (still today) domestic service. The reform that took place in 2011 was presented as an undeniable advance in the formal dimension that should promote the substantive equality. It discusses the extent to which goals are being achieved, as well as the deficiencies that still exist and that hinder to achieve, or at least promoting, the equality of opportunities.

On November 14, 2018, the II General Seminar on Domestic Work was held, within the framework of the Permanent Seminar with the same name. At 16.00 a round table was planned in which CCOO, UGT and USO were represented. The act was moderated by Professor Patricia Nieto Rojas. The subject of the debate focused on one of the future Challenges of Domestic Service Work, that of the collective representation of domestic workers. The moderator would ask some questions that would be discussed by the table among themselves, and with the audience. Doña Elena Blasco answers those questions, whose considerations are translated here.

The purpose of the work is to study the current situation of Social Security protection of domestic employees, indicating the specialties of this protection in relation to the rest of the workers. In second place reform lines are indicated in order to the total homologation of the legal regime of the Social Security of this type of workers in relation to the rest of the general regime.

We are currently still noticing a maternalist and servilista trend towards domestic problems, so to improve the working conditions and social protection in this sector need to professionalise activities carried out in domestic service, as well as that the Government be involved at different levels, to respond to this need, such as the ratification of the Convention 189 of the of the ILO, as well as sensitize the employers to the connection.

The labour and social security inspectorate has as its mission the monitoring and demand of compliance with the current labour regulations, also the rules regulating the relationship of familiy home service as well as the rules relating to the special system of social security of home employees, becoming an instrument guarantee of its effectiveness. The article intends to analyze the peculiarities of the inspecting actions in these relationships and the behaviors that may be constitutive of infringiment in all dimensions of the inspecting action.
