This article analyzes the consequences of the incorporation of communicatives technologies in the youth dynamics of use that comprise some work scenarios, that derive in figures like social media content managers, or youtubers. In particular, from some stories of young people in Tijuana about their social uses of the internet, computers and mobile phones obtained through interviews, the leisure and work logics that converge in this scenarios are related to think about their scope in terms of life project, social mobility and well-being.

This paper will study the figure of the national margin of appreciation and its application by the European Court of Human Rights. The purpose of this study is to show that the frequent use of this figure prevents a uniform interpretation of the right to freedom of thought, conscience and religion in the European System of Human Rights. To test this hypothesis, the aforementioned figure will be compared with the control of conventionality and the way in which the latter figure has been applied by the Inter-American Court of Human Rights. The latter in order to highlight the interpretative and protection flaws of the rights generated by the use of the national margin of appreciation.

The aim of this research is carrying out a critical analysis about the Spanish law concerning international bribery. After studying the general matters, some controversial aspects regarding the topic are addressed, such as the inclusion of facilitation payments, the concept of international business, the importance of the so called “error de tipo” in these cases or the futility of certain rules because of procedural issues. This analysis leads to conclude that committing reforms in this field is necessary, especially in the procedural aspect. Yet, such reforms seem to be as relevant as a battery of policies to promote greater social awareness.

In 1978, the Spanish Constitution designed a system of self-government by means of negotiated Statutes for the accommodation of the most differentiated territories. It recognized them as nationalities endowed with historical rights and therefore with a title preceding the Constitution itself in time and also, virtually, at law. Even the referenda of initiative for access to autonomy that had been carried out under the previous Constitution, that one of the Second Republic, were constitutionally revalidated. In this way, the Basque Country and Catalonia were constituted in 1979. It was a process that soon began to be distorted. The Constitutional Court, barely established, began in 1981 a meticulous work of sabotage of such a framework of self-government. Here is a case of truly preventive jurisprudence or, as it would turn out, juris-imprudence. That is what this paper is concerned about.

In recent decades there has been a significant development of European and international legal instruments related to prohibiting racial and ethnic discrimination. Nevertheless, this regulatory framework needs further improvement and implementation so that it can also combat new forms of discrimination. Along these lines, this article critically reviews international and European laws on discrimination and sets out the current state of the question. Based on this analysis, it proposes strengthening legal standards to reinforce protective measures against discrimination and enhancing the role of specialised bodies to foster equality, with the end purpose of fighting against racial and ethnic discrimination more effectively and efficiently.

The idea of absolute certainty -typical of the first alethic realism- found an ideal habitat in Law and it rooted deeply into it. The epistemological unsustainability of this notion and the harms it caused to the legal debate were denounced clearly by Luigi Ferrajoli and the following scholars (i.e. the «fact-theorists»). This paper is aimed, on the one hand, at assessing the work of these jurists and provide food for thought on the topics of truth and procedural knowledge; on the other hand, it tries to show that the problem of the «rehabilitation» of alethic realism in the legal field still remains open and full of interest for the philosophical reflection.

The theoretical treatment of collective rights and their controversial nature maintain important relevance both from the political and moral philosophical perspective and from that corresponding to legal dogmatics. However, the treatments of this category formulated by legal theory are receiving less and unjustified attention. In this paper, special attention is given to the study of Caracciolo, and Jovanović’s respective works on the subject. It concludes that the intended theoretical approaches of conceptual analysis collapse into an ideological approach on the acceptance or rejection of the category.
