Resumen
I inquire about the existence and limits of a moral principle of non-interference with privacy, such that should be constitutionally sanctioned. I evaluate various alternatives of conceptualization and assessment of its ground: personal autonomy. Those who refuse its value will have defl ationary conceptions of noninterference. But valuing it does not involve a single mode of conceiving it. I assess a broad formulation that is not committed to any conception. Then I present Frankfurt/Dworkin´s and Raz’s conceptions. For all of them I highlight the consequences that follow concerning the delimitation of the scope of negative freedom, offer a wording of the warranty consistent with each posture and contrast it with hard cases.

The paper lays down a conception of criminal attempts, grounded upon an analytically oriented theory of norms, which identifi es the wrongfulness-defi cit of the behavior imputable to the agent as its differentiating mark. Such “offense-imperfection” is explained in the sense of a lack of full performative congruence between the objective configuration of the agent’s behavior and its declarative value. This is than related to the debate regarding the problem of “moral luck.” The argument soy displayed makes recognizable the centrality of the concept of dolus for the clarification of the concept of attempt, as well as the sufficiency of dolus eventualis for the ascription of an attempt

The object of this paper is to contribute to the growing development of contemporary contract theory in Chile. Contract law requires political justifi cation, and contract theory plays a crucial role in such justifi cation. The paper analyzes the need for a theory of contract law, explores its methodology and draws a distinction between the role of contract doctrine and contract theory. Finally, the paper analyzes their relationship.

Resumen
The paper seeks to state a very specifi c argument to reject the proposed abortion bill in Chile. This bill has today become current law. The argument was its intrinsec inconsistence with the Constititution, the precedents of the Constitutional Court, the civil law, and all normative structures related to the use of chilean legal system. The reason argued relies ultimately on the logic relation requirement between parts or elements of a legal system, so that there should exist no contradition nor opposition between norms and their interpretation. In order to demonstrate the point, several norms and sentences are quoted, so the reader can realize that the aforementioned bill is alien to chilean legal system.

Resumen
This article proposes that the Inter-American Court of Human Rights has not confi gured an univocal concept of conventional internal control. On the contrary, it has proposed several meanings that extend its control subjects, object and control parameter, which makes this construct za “process in works” that generates doubts. In this regard, it identifi es, in the jurisprudence of the contentious cases of the last decade, the meanings attributed to the conventional internal control, segmenting three phases or stages of development. Likewise, itrecognizes in each of the stages the subjects, parameter and object of the control, verifying if such elements expand or constrict. It also raises a series of questions about the precision and consistency of the meanigin conventional control.

Resumen
This study examines and compares the indictable offense of forgery in the legal sources of Hispanic and Anglo-Saxon territories from the 15th to the 18th centuries, including medieval legal background. An attempt is given to determine the origin and development of its distinguishing notes and the interest legally protected, as well as its subject-matter and the offenders’ responsibility. Special emphasis is given to the development in the typology of punishment in English and Hispanic territories, providing numerous examples from the Ejecutorias of the Real Audiencia y Chancillería de Valladolid and the trials held at London’s central criminal court from 1674 to 1830.

In this area, one of the questions that arises about the action where this right is executed is whether it constitutes an essential procedure in the terms established in the law to allow theappeal of cassation. According to the Chilean Supreme Court, contrary to what this study holds, it is so.

Taking into account the regulatory purposes of administrative sanctions against corporations and the observable trends in comparative law, the article aims to show that, in the absence of explicit statutory regulation on the administrative liability of corporations, there is a basisfor interpreting Chilean sanctioning administrative law as granting corporations a defense based on the implementation of an adequate compliance model to prevent illicit acts committed by their low-level employees in exercise of their functions

Resumen
Chilean law has been supportive of arbitration as a dispute resolution mechanism. Law No. 19,971 of 2004 extended such support to international arbitration and introduced a clear pro-enforcement bias in favour of foreign arbitral awards. However, court decisions remain rooted in requirements and analysis that are inconsistent with Law No. 19,971 of 2004 and applicable international treaties, which may affect the Chilean pro-arbitration profile.
