Resumen
Non-pecuniary damages in contract law are anywhere a strongly debated issue. The problem is not anymore that these kinds of damages are forbidden but the conditions under which they should be available. Th is work intends to present and, to some extent, critically examinesome decisions of the Supreme Court on this topic issued from 2005 to 2016 and proposes some devices to face what is called here a “liberal answer” of the Supreme Court.

Resumen
The article analyzes the institutional and fi nancial reform agenda proposed by President José Manuel Balmaceda between 1890 and 1891. Based on a review of press media and congressional records, the article shows that since 1890 the balmacedismo promoted a constitutional and fi nancial reform aiming to extricate the Executive branch from the Congress and its control through parliamentarian practices.

Since it can be noted that our legal system pressuposes a category, the ius commune, this article aims to specify its current content. The ruling of the Tribunal Constitucional Rol Nº 2922-2015, that declares inapplicable the fi rst paragraph of the article 29 from the Law Decree No. 3,538 of 1980 is studied since it lacks enough criteriato determine the penalty of a fi ne. The paper analyzes the need, or even the essentiality that the appealed precept grants legal standards for determining fi nes. It also seeks to establish whether its current structure generates a constitutional conflict.

Resumen
Party autonomy in international contracts is not statutorily accepted in some Latin American countries where national courts vacillate as to upholding choice of law clauses. The acceptance of autonomy therein is needed to eradicate juridical uncertainty and to harmonizeconflict rules within Latin America. OAS’ countries drafted The Inter America Convention on the Law Applicable to International Contracts, Mexico 1994 with this objectiv but it failed to achieve it. Thus, harmonising amendment of the domestic confl ict rule on contracts of these countries is pending and might be fostered by a fl exible non-bindin international instrument that includes rules on autonomy widely accepted in comparativ law and respectful of their legal tradition.
