News reports on pending litigation seem to be protected in two ways: by the principle of public judicial proceedings, and by freedom of/right to information. In procedural matters, both appear to refer to the same object, and even to be coincident. But the distinction and differential treatment of both rights remains relevant and necessary, since one seeks to protect the integrity of the process, while the other seeks to contribute to the formation of public opinion on matters of general interest. Also, it is relevant when it becomes necessary to restrict or regulate practical situations, performing the analysis from one perspective or the other.

This paper analyzes the Chilean experience regarding process of appointing heads of independent regulatory agencies (IRA) using a database that gathers information of several appointments in different regulatory agencies. The data shows that standards of formal independence are rather low. The processes of selection led by the Supreme Court, the Antitrust Court or Central Bank show better results, so seems reasonable to continue with the incorporation of multi-member panels and transparency.

Some authors assert that the European Court of Human Rights (ECtHR) adjudicates social rights through an indirect connection between civil rights and social rights. This puts into question the legitimacy of its decisions, being that it is a civil rights’ exclusive supranational Court. In order to review the degree of respect for the creativity margins in judicial interpretation, this paper classifi es fi ve levels of social rights, identifying both thecentral case and those of the penumbra, in order to review the previous statement in the most recent and relevant caselaw of this Court in light of this classifi cation.

This study stems from of the dissatisfaction of the way it has been addressed by the traditional view, the wording of the facts in an appeal for protection, where it has avoided the narrative, argumentative, symbolic and momentous power that holds this task. Then, it intends to present, from rhetoric and linguistics, that establishing, the facts of an appealfor protection is a complex process, refl ective, defi ned through various stages, always provisional, which can be enriched by a constant deliberation, a general design of the action and certain schemes that seek to do the job more effi ciently.

The theoretical way in which the majority doctrine addresses the control of conventionality, could be signifi cantly modifi ed if one takes into account the real level of compliance with the judgments in which the Inter-American Court has ordered to carry out. The present work analyzes this data, almost always omitted, and incorporates it into the doctrine of conventionality control, to try to determine if such control is viable in practice. Shareholders agreements on corporate director’s voting are frequently used in national corporate legal practice, but there is no agreement among legal scholarship about their validity. An analysis based on the foundations of corporate law, reveals that the diverse role of these agreements in publicly held or closed corporations is crucial to determine their validity or invalidity. Based on these foundations, a regime of validity or invalidity of these clauses is built.
