Based on a comparative evaluation of the case law of the Constitutional Courts of Peru and Chile on implied fundamental rights, this work evidences some strengths and weaknesses of the foundation and determination of these rights. The aim of this work is to introduce an alternative account for the understanding of implied fundamental rights. This alternative account does not deny the dual nature of law held by Alexy’s non-positivism, but it goes further and it can be identified as a “Moderate Natural Law Theory” approach of those rights

The proceedings for establishing the responsibility of the State are not adapted for the reality of the victims. They do not guarantee effectively and within a reasonable period the fundamental right to a full reparation. In light of this statement, this paper enquires about the necessity of establishing a transformative procedural law through the use of new proceedings that may grant reparations to the victims of the Colombian armed conflict, even within the context of the Peace Agreements and the post-conflict, where the magnitude of the number of victims is relevant. This necessity could be satisfied by using case law and the special administrative proceeding for extending the State Council’s case law to third parties (an administrative procedure that was created for making the Public Administration issue the judges’ words to situations that have the same facts and legal issues).

La importancia del precio es indudable para los operadores del mercado. Además, los cambios que se llevan a cabo en un ordenamiento jurídico pueden conllevar un impacto inesperado en los precios; por lo tanto, los reguladores deben ser especialmente cautelosos cuando diseñan herramientas legales para evaluar la adecuación a la legalidad de las prácticas de fijación de precios. Este estudio demuestra que de todas las ramas del ordenamiento jurídico son el Derecho de la competencia y el Derecho fiscal las que tienen un mayor impacto sobre los precios que las empresas fijan en los mercados en los que operan. Por medio de un análisis comparativo de los mecanismos empleados por las autoridades administrativas de cada rama identifica las sinergias que favorecen que una aprenda de la experienciade la otra en materia de evaluación de precios injustos

The obligations of the carrier under the charter agreement are analysed accord- ing to the current Spanish Shipping Act 14/2014, of July 24. The aim is to demonstrate that this recent Act has clear historical bases that would lead to a common European framework in maritime agreements, if national policies were developed in this sense. We examine the most relevant historical texts to support this hypothesis.

This article reviews the exercise of legislative power delegated from the 1833 Constitution to the present. In the XIX century its use responds to broad authorizations from Congress, which include Congressional Legislative Power. In the XX century, rules of legislative force and effect were born as practice praeter constitutionem in 1927 and contin- ue to operate as broad authorizations to regulate with the status of law and not as precise mandate. Its main initial use between 1927 and 1932 (control of public expenditure and reorganization of the public administration) is maintained throughout the past century. Its incorporation to the Constitution in 1970 and then to that of 1980, tries to reinforce its commission character. However, in practice, the delegation continues to function as an au- thorization to regulate matters of administrative organization with legislative force and effect

This work seeks to analyse the defence of constitutional review made by the Italian legal theorist Luigi Ferrajoli and how it is related with his conception of democracy (a conception marked by antipopular elements). In order to do this, it takes four particularly relevant aspects in Ferrajoli’s reconstruction of democracy (understood as substantive democracy) and its relationship with constitutional review, namely (i) the idea of separation between form and substance, (ii) the denial of conflict between rights and the absence of judicial discretion, (iii) the pessimistic view of politics (that contrast with Ferrajoli’s optimist view about judicial work) and, finally, (iv) the paternalistic elements imbedded in his conception of democracy.

Regarding those who have favored the alternative of “returning” to the Consti- tution of 1925 – hence, back to the “Chilean constitutional tradition” – as the foundation in shaping a new institutional order, this paper states that there is no clear continuity between the 1828, 1833 and 1925 constitutions. Furthermore, the legitimacy by origin in both for- mer cases is debatable, as well as latter’s legitimization by exercise.

This article analyzes some procedural problems related to joint and several lia- bility legal action, which arise from the thesis that multiple obligors are bound by the same obligation towards an obligee when such liability is declared. Recently the Supreme Court has ruled on a neighborhood conflict initiated due to the implementation of a rainwater collector that artificially led and unloaded its torrent on a neighboring property. This rulling is useful to address neighborhood relations as limits of property in private interest, distinguish between direct and indirect attacks on property, and in particular, to emphasize that administrative authorizations and the compliance with laws and regulations do not justify the infringement of third party rights.
