Resumen
Intellectual Property Law, in its broad sense, was of primary interest to the Chilean law makers since the beginnings of independent political life. The promotion of arts, culture, industry and development, advanced in parallel with a secure protection on the property of authors and inventors regarding their respective creations. This article analyze the development, different approaches, discussions and sources of those first laws regarding Intellectual Property, which made Chile one of the first former colonies who regulated that area in detail.

Resumen
Liability insurance contract’s legal design grants the direction of the defense of the liability claim and lawsuit to the insurer. Sometimes, the interests of insurer and insured are opposed, which is manifested in the differences between them related to decisions about the defense of the liability claim or trial. The thesis that this work supports is that liability insurance’s legal regulation restricts the option to give the defense of the trial’s direction to the insurer only to cases of conflict of interests in a strict sense. The former does not mean that the other conflicts of interests do not produce any legal effects, but that these legal effects are others: those that arise from the agent’s tort liability in a collective agency.

Resumen
This work aims to study the new dimensions of fundamental rights in the digital society and the challenges for its protection. The first part of the paper focuses on the regulation and the governance of the Internet. After that, it analyses the role of fundamental rights in the cyberspace and, in particular, the fundamental rights will be considered as guiding principles of the Internet’s architecture. As a final conclusion, the paper addresses the question of whether a constitution of the cyberspace is needed.

Resumen
This paper aims to examine the irrevocable mandate in civil, commercial and consumer matter and irrevocability arises, first, as a result of an agreement to that effect and secondly as a result of the presence of interests of the representative or thirds. We question the general acceptance of the irrevocable mandate without previously making these distinctions that are fundamental to rule on its acceptance or rejection. The issue has enormous practical interest because it has become customary to introduce this kind of mandates in all types of contracts, especially in adhesion ones.

Resumen
This paper analyzes the legal and economic nature of the wind as an energy resource in Chile. It holds that wind is becoming a rival good that is originally assigned privately under a rationale dominated by the principle of accession. It suggests that this assign- ment is subject to criticism from an efficiency and distributive perspective. As an alternative, it proposes to follow an acquisition by first possession logic by means of a symbolic form of occupation and discusses its implications.

During this paper, we will focus on the civil procedure exam as a decisional context in which it is possible to apply academic analysis of law. In that regard, we do not seek to exhaust the debate as to whether economic analysis of law and efficiency criteria (for which content is acquired) enjoy recognition in the system of Civil Law or are admissible as decision criteria. The purpose of this article is more straightforward. We seek to indicate the reasons why in those civil proceedings in which efficiency is admissible as a decisional factor, the appropriate incentives are generated to internalize the cost of obtaining a favourable pronouncement, producing sufficient information to resolve the issues in which efficiency is recognised as a decisional factor. This leads to the discrediting of the habitual belief that efficiency demands that the proceedings generate enough information to make its recognition as a decisional factor impossible.

The paper analyses the content of the auxiliary institutions under which the medical treatment of incompetent patients is justified. Regarding this, the statute N° 20.584 is imprecise and its treatment in the Chilean literature problematic. The purpose of this paper is to present the grounds for the reconstruction of these institutions in Chilean law.
