The “disputed material facts” depend on the object of the process. In order to determine these facts, the judge must consider the narratives of litigants and the convergence between the primary facts and evidential facts from the case. Accordingly, the law must require lawyers not to use generic stories, and the facts contained in the court decision orde- ring present evidence must not be generic either. Based on an example of tort law, this paper shows that the hermeneutic approach rather than the analytical one provides justification for the convergence between both types of facts.

In this paper, the author analyzes conflicts between geographical indications and between them and trademarks. In particular, she analyzes the applicability of the principles of trademark law to appellations of origin and geographical indications, the specific rules for geographical indications and cases of coexistence of distinctive signs as established in the TRIPS Agreement and in Argentine law.

From the revision, in essence, of the press of that time, it appears that in the middle of the revolutionary climate that Chile was living in 1925, conservatives saw so radically questioned their vision of the world, that they adopted a firm defensive position of the old order (parliamentary system); notwhitstanding that within it arose also divergent positions. There were those who wanted to democratize the system, others that social rights were enshrined and a few defended the corporatism.

This paper states that individuals’ duties have a considerably more extensive role in contemporary constitutionalism than usually attributed to them. While explicit constitutional duties are not the general rule, several scholarly and judicial constructs are centered on duty-based considerations. Such is the case of the doctrine of third party effect of fundamental rights, the thesis of correlativity of rights and duties, and some conceptions regarding limitations of fundamental rights. That being the case, it discusses possible justifications for the express constitutionalization of duties.

Before factors that undermine the Commercial Code, such as: laws going astray from the Code, globalization and the binary nature of Commercial Law (which has both “authoritarian and anarchical roots”), the paper argues the permanence of the Code. The study proposes the revival of the Code’s central role in the legal system, throughout the enshrinement of the axis of modern Commercial Law: the principles of good faith and party autonomy, and the enterprise.

The paper critically reviews the thesis that assumes that cybercrimes protect a specific computer-related interest. On that basis, it states that to recognize an interest with those characteristics is justified if these crimes, besides influencing computer software, involve the use of computer networks. To define their object of legal protection, the study reflects on the roles that computer systems play on the free development of the person and the institutions that serve her in a democratic state of law

The Chilean Supreme Court recently issued the final judgment in Case No. 31.179-2015, in which, in our view, it held a doctrine that rectifies a severe mistake incurred by the Second Environmental Court (Case No. D-13-2014), when accepting a motion to dismiss based on lack of subject-matter jurisdiction. Indeed, as it will be explained, in our view, the Second Environmental Court had issued a judgment (which was confirmed by the Court of Appeals of Santiago, Case No. 5-2015) which showed a considerable confusion regarding the implementa- tion of the rules governing the liability for environmental damage in our country.

This paper reviews a Supreme Court ́s judgment regarding the current notion of profit in legal entities, specifically in case of a public nonprofit organization. Based on the tax assessment rule of Article 35 of the Income Tax Law, this paper criticizes the Court ́s reasoning that earnings obtained by this kind of entity in the development its business activity do not qualify as revenue based on the fact they are exclusively destined to charitable purposes.

The author proposes that the reasons developed by the Inter-American Court of Human Rights to reject requests of advisory opinions seek to preserve the subsidiary character of the regional system of human rights. However, the article shows recent cases in which the Court has not been completely consistent with its own previous decisions on this matter.
