Resumen
This article addresses the legal issues arising out of the potential ratifi cation of the UN Convention on the Law of the Sea by Colombia. The authors posit that the majority of the concerns previously deterring Colombia from ratifi cation have progressively disappeared. Yet, they transitorily discourage ratifi cation due to Colombia’s current claim of historic rights in the San Andrés Archipelago

Resumen
In the fi rst half of the XIX century, cemeteries were created on cities’ outskirts and a mutual understanding was achieved between civil and ecclesiastical authorities regarding their legal regulation. The 1883 Secularist Law of Cemeteries broke this consensus. However, civil and canon law developments during the twentieth century made possible a new convergence. Nowadays cemeteries have a regulation stating a new consensus reached between state and church.

Resumen
Is the Presidential Power to declare states of emergence immune to judicial review? This is the key question addressed in this article. Based on legal arguments as well as historical, comparative, doctrinal and case-based arguments, we conclude that the Executive Branch is above the Judicial Power when it comes to interpret the emergency rule. Underlying this statement rests the idea that the text of the Constitution is not wholly enforceable by the judiciary

Resumen
In eleven novels over four decades, Toni Morrison’s fiction has dealt with such prickly issues as the hold that the past exerts over the present, the power and perils of small communities or the wounds caused on bodies and minds by all sorts of abuses. Her latest novel, God Help the Child (2015), revisits some of those earlier themes, but it focuses more closely on the topics of child abuse and colorism –the internal racism of blacks against darker skin shades. What is new in God Help the Child is that the story is set in present-day California, where the rate of child violence and victimization –especially among black children– is just overwhelming. The main aim of this paper is to show that, despite Morrison’s unquestionable narrative skill and her audacious form –with constant shifts in point of view and language–, one must conclude that the theme she tries to tackle in this slim novel is far too complex to be properly probed in this short span.

A genetic analysis of the manuscripts and editions of six poems relating to the “Locas mujeres” section of Lagar (1954) by Gabriela Mistral, published between 1941 and 1943 by La Nación of Buenos Aires. “La dichosa”, “La desasida” and “La abandonada”, along with “La trocada” and “La tullida”, which were omitted from Lagar but included in manuscript indexes, and finally “La otra”, a poem which appears in the volume Poesías completas (1958) and also belongs to the “Locas mujeres” series. The present study allows us to dismiss the biographical interpretation of these texts as being linked to the death of Juan Miguel Godoy, a reading proposed by Palma Guillén and echoed by a section of Mistralian critics.

St. John of the Cross’ strange mystical birds have baffled readers for a long time because they seem foreign in the context of the European literary canon. This is not surprising, given the poet’s usual artistic mysteries, which make for a difficult reading. Dámaso Alonso warns the reader: St. John’s poetry is “mysterious like an aerolite”. After exploring St. John’s literary enigmas for decades, it is not difficult to concur with the Spanish critic. I have carried out a comparative study of the mystical symbolism the Spanish poet seems to share with Sufism (see (López-Baralt 2000), and also of his ornithological allegories (see (López-Baralt 1985/1989 y 2012), which I explore in depth and actualize here, trying to understand their elusive origins.

Resumen
The central theme of this work focuses on theoretical proposals in the literary field, towards the first half of the twentieth century in Hispanic America, particularly in Pablo de Rokha’sproject developed in the text “La épica social americana”, incorporated in his book Arenga sobre el arte (1949). Our premise is that “La épica social americana” is an appropriation of the avant-garde totalitarian discourse, projected in the heroic image of the poet, whose writing should consider the contact between enlightened culture and popular culture.In this context, the aim is to recompose topics and the lines of meaning that order the theoretical discourse of Pablo de Rokha, attending to the emphases and connections with the cultural and literary discourse of his theses. Consequently, the center of the discussion demands the use of interdisciplinary concepts and categories, where the idea of appropriation is fundamental, in connection with the context in which the text was produced.

Resumen
This paper focuses on Gabriela Mistral’s after 1925 thought pedagogic. It is the first time she comes back to Chile from abroad. She then withdraws from teaching and stays in the country until she starts her life as a diplomat. Henceforth, a progressive distance and scepticism from the school as an educational institution starts to develop. She explores two possible answers to this problem. On the one hand, she queries the possibility of unschooling the didactic matrix of the school. On the other, she reflects on the education that autodidacticism provides the non-schooled. For this purpose, this paper takes into consideration the latter approach and the way that it relates to Mistral’s view of the reading process as formation of a reader-as-creator.

Resumen
I will analyze in this article how José Ángel Valente uses the mystical modus dicendi to explain his own Poetics. I will do it by studying different essays by the author, looking for the systematicity of his thought. In the first place, I will focus on what Valente understood by “mysticim” from the point of view of his poetic writing. On the Secondly place, I will study his Poetics in order to analyze the rhetoric of his essays and to analyze his use of a religious technical vocabulary. Finally, I will discuss critically Valente’s conscientious use of mystical tradition.
