In his research on theGovernance of the Rule of Law (1936), Franz L. Neumann (1900-1954) claims that nineteenthecentury liberal capitalism had transformed into an Era of monopolistic capitalism in the twentiethecentury. Ths, according to him, led to the disintegration of the rule of law and the rise of authoritarian rule. this article revisits Neumann’s critical legal theory and discusses his Marxist theory of decay. theauthor claims that by revising the schematic Marxist opposition, we can open up pathways of renewing Neumann’s dialectical theory of law.

Horkheimer and Adorno in Dialectic of Enlightenment, and Neumann in Behemoth, have tried to understand the genealogy, the structures and the practices of fascism in particular through Hobbes’ philosophy. However, despite their common membership in the Institut für Sozialforschung, they disagreed on the continuity between Hobbes’ absolutism and European fascism. Horkheimer and Adorno were convinced that Hobbes’ absolutism and fascism have shared the same anthropological origins, the principle of “Self-preservation” being at the root of absolutism as well as fascism. In both cases, the power is benefiting the dominant class, and creates an expanse where individuals destroy themselves. However, according to Neumann, absolutism and fascism are opposed, because Hobbes’ “Leviathan” is a real state and differs from nazi «Behemoth», which is a non-state. The human reason that grounds the civil state is not just “instrumental”, but also emancipatory.

The aim of this article is to provide a panoramic exposition of Hannah Arendt’s thought about the issue of evil. In order to achieve this task, I will pose briefly Kant’s approach of ‘radical evil’, which had an enormous relevance for Arendt. Then, I will point out the stance held by her in The Origins of Totalitarianism and later to explain the way Arendt changed her mind after Eichmann in Jerusalem, particularly through the term ‘banality of evil’. Finally, I advo-cate that both notions constitute not only a continuity but also they are compatible each other.

The article focuses on Walter Benjamin’s enigmatic essay Critique of Violence from 1921. The author interprets it in the context of the political ideas of the German Youth movement before and after the First World War. Different from other interpretations, he focuses more on a certain political act than on a usual messianic way of reading. It becomes evident that Benjamin refers to an act not far from for example Kierkegaard’s decision in ethics. In the second part, the author discusses some recent misinterpretations and points out the actuality of Benjamin’s heterogeneous and highly political conclusions for today.

The present essay aims to exhibit the manner in which Gramsci and Benjaminrecover the principles of Marx’s historical materialism to carry out the critique of political praxis, during the fascist period. From them it is possible to understand the indissoluble connection between history, politics and ethics in political praxis, as well as critique as a movement inherent to knowledge and practice, it is proposed to know, and modify, the structures of coercion that are set up in the knowledge and in political praxis. From Marx, Gramsci and Benjamin it is possible to undertake the task, necessary in the present, of knowledge and political praxis where it is imposed a unilateral discourse over the conception of society, the life and beliefs of the concrete subjects.

The translation of Christoph Türcke give account of a problem whose actualityis unavoidable, namely, the problem of political praxis, of political activism, andits relation to the theoretical work of philosophy. In Adorno, praxis means severalthings, as well as human action, in general. An action in which it is expressed theself-determined reason and rational self-determination. Only this would be a truepraxis worthy of man, namely, adequate to the human rational capacity. The social reality is very far from it. Hence, “praxis” also means the establishment of the conditions under which the aforementioned maxim of praxis is possible.

The philosophy of the limit of Eugenio Trías proposes an ontological theory where three areas [cercos] are distinguished (of the appearance, hermetic and bordering) and four neighborhoods of the border city (philosophical, religious, aesthetic and ethical). This text explores the last of them. It analyzes ethics as an event in which three classes of subjectivity intervene: subject 1 (issuer of the order), subject 2 (receiver) and subject 3 (agent). On the other hand, that ethical-metaphysical conception is remitted to a religious inspiration, that of biblical Israel, and related to the contemporary experience of barbarism.

Theory of justice generally addresses issues within national borders, which means that justice and injustice only take into account what happens inside the borders of a country and those are recognized as citizen of that country. However, in recent years the debate around theory of justice has focused not only on what an injustice is, but also on who should be taken into account as subject of justice. Injustice could be also understood as the exclusion performed by institutions towards subjects who are not taken as citizens, making it impossible for them to claim justice. So the question is: how can we establish who is a legitimate subject of justice?

Here we present a reflection that seeks to show the fundamental problems of the cult of spontaneity that is prevalent not only in the political sphere but also in the academic. I attempt to show how the politics of the present fundamentally needs a moment of theoretical pause, not only to analyze its own scope, but also to discover the means most suited to its own political intentions. This reflection on political praxis also gives rise to reflections on moral philosophy in general, specifically on the material possibilities of moral action in the social context of capitalism.
