Although the disciplinary law of the Roman Curia and of the Vatican City State has not been thoroughly studied, it ought to be further explored due to its particular nature and field of application. In fact, and with a certain amount of frequency, confusion arises among experts concerning the procedures to be followed in imposing disciplinary sanctions. Disciplinary law relating to work sub umbra Petri is addressed in this study, with particular reference to the two Regulations of the Disciplinary Commissions of the Roman Curia and of the Vatican City State. A comparison is made between the two Regulations in order to bring out the points of parallel and discrepancy, shared features and established limits, in the hope that the latter may be overcome in the future by the canonical and Vatican legislator.

This article discusses European Parliament Resolution 2020/2215(INI) on the situation of sexual and reproductive health and rights in the European Union in the context of COVID19. In particular, it focuses on issues such as abortion and conscientious objection. The normative text is studied, in particular regarding whether the Parliament’s new resolution may imply a change of direction in European law and jurisprudence, as well as the influence that the definition of abortion as a fundamental right may entail in relation to the future jurisprudence of the European Court of Human Rights, and the scope for action available to Member States.

Against the background of a broader discussion about the role of legal precedent in the jurisdiction of the Supreme Tribunal of the Apostolic Signatura, this paper focuses on certain aspects of its jurisprudence in terms of legitimacy and the exact observance and uniform interpretation of the law. Focusing on the specificity of some definitive sentences in which, hypothetically speaking, the ratio decidendi may be identified as an indispensable assumption of precedent, the paper emphasises some advantages of judgement based on precedent. Drawing on an analysis of its legal activity, it may be concluded that judgment via precedent is, for the time being, a principle of lege ferenda.

This article analyses the similarities between public international law and canon law in the legal treatment of the human person. International and canon law endowed the legal concept of person with an overly technical and reductionist meaning. This reductionist conception of the person has prevented the proper development of both canon law and international law. However, just as international law today has rectified its course and is gradually becoming a global law, increasingly focused on the human person, so too canon law, to fulfill its evangelising purpose, should be globalised. The globalisation of canon law subordinates the centrality of the already baptised Christian and, instead, prioritises the centrality of every human person created in the image of God and called to be regenerated in the baptismal waters.
