The new legal framework that was established following the Constitution approved in 2008 has given way to an important recognition of rights to people in Ecuador. However, currently within the proce-dural scope could cause a violation of constitutionally recognized rights, because of the contradiction that is registered between the rules that promote Judicial Activism and those that promote the consti-tutional Guarantee. In this context, the methodology used in the present study is based on a bibliogra-phical investigation, which allowed to have an accurate outline of constitutional guarantee against ju-dicial activism on everything related to the due process of the administration of justice in the country. On the other hand, the criterion of two professionals in the field of Law was also used to learn more about the current situation of the country in relation to the variables under study. Finally, it can be es-tablished that the Constitutional Guarantees are legal tools that are used to somehow prevent, stop or amend the violation of any Law that is recognized within the Constitution, while the origin of Judicial Activism dates back to the Age Media, where, the very actions of the Holy Office led to the granting of greater concessions to the judges. Characteristic that still continues being one of the fundamentals of the activist doctrine in the present moments, obviously, through different arguments to those adopted by the inquisition.

The objective of the research is to determine the existing perspective of decolonial ethics, and what it means for the Ecuadorian State interculturality and plurinationality constitutionally established. The decolonial ethic is a tool of transgression that is related to the internal processes of globalization. It should be noted that the Constitution of the Republic of Ecuador clearly states that it is a State of rights and justice, social, democratic, sovereign, independent, unitary, intercultural, plurinational and secular which is inalienable and imprescriptible. The study is qualitative-descriptive based on the her-meneutics and the comparison model. The purpose of the study is to deepen the meaning of deco-lonial ethics and compare it with what the Ecuadorian State pursues in its Constitution. Question the knowledge of decolonial ethics towards the pluriculturalist process offered by the Ecuadorian State, with the intention of governing a series of ethical principles that provide respect, security and equality among the inhabitants. Finally, this study wants to take advantage of the fact that the State constitu-tionally promotes and respects plurinationality, to develop an integrative plan adapted to the environ-ment and the law of the citizens of Ecuador.

The socio-spatial behavior of urban peripheries as a form of use and appropriation of space that characterizes these areas of Latin cities in general and the city of Quito specifically responds to accelerated urbanization processes that have developed since the second half of the twentieth century and continue today in Latin American cities. They are the reflection of an unsustainable urban development that must be addressed, hence this work focuses on the social, cultural, environmental and urban behavior of the urban periphery as a goal to improve and enhance these areas; articulate them to the rest of the city, strengthening them as an integrated system of social production of habitat. The result evidences the process of peripheral expansion - dispersion, low housing densities, infrastructure and service deficits, which in most cases do not contribute favorably to the quality of life of the people and the environment in which they live. The urban periphery as a socio-spatial phenomenon is the reflection of a transformation of space and of a social stratification with very clear forms of appropriation and use. The city of the 21st century must provide more efficient responses to these sensitive areas and the population that inhabits them.

Conceptions for psycho-pedagogical orientation should be assumed as one of the challenges for the improvement of university practice; with emphasis on the institutional level and career groups. The identification of this problem allowed to analyze the theoretical reflections that configure the methodological position of the actions proposed in the article. The result of this process has been gradually enriched from the institutional strategy so that the tasks or activities rest in a comprehensive conception of the training process in intimate relationship with the other areas of service and management. The experience developed in the last two semesters at the UMET, allowed to establish the procedure that should govern the educational actions so that they impact on university practice until reaching the level of integration, coherence and systematicity that is required in this type of orientation. The conceptions that are presented weigh the responsibility in the methodological and linking work; as well as the importance of specifying the intent of this process in the design and development of the curriculum.

This essay develops a reflection on the concept of culture in the contemporary context defining key notions for the formulation of cultural public policies in the 21st century such as identity, cultural diver-sity and interculturality. It also offers a basic conceptual framework on culture with a broad and plural vision, since the concept with which it operates will be reflected in the ways of intervening and will de-termine the logics that should be taken into account when formulating the guidelines and implement cultural policy.

The generation of agile business models is vital for the survival and innovation of business initiati-ves. The objective of this study is to develop the Canvas business model at the Adriano Palta bakery in the Tababela parish, since it is a business that offers its customers a variety of products, mainly bakery, of good quality and at a convenient price. However, it does not have an adequate performan-ce in the market, which has generated a decrease in its sales and a low flow of money. The diagnosis was made with the application of a survey to a random sample of 60 clients and an interview with the owner of the business. This allowed to establish the strengths and weaknesses of the bakery Adriano Palta. From the diagnosis, the Canvas or canvas of the business was designed, which includes the business model in a single sheet. This has taken into account the shortcomings and possible solu-tions. In conclusion, the implementation of the Canvas business model at the Adriano Palta bakery will increase sales and revenues to make it profitable.

Innovation is important for the economic and social dynamics and has been placed as a key factor both at company level and at the country level. At the company level, the role of innovation stands out because of the contributions it makes both to productivity and to the competitiveness with which they operate, while at the country level, the influence it has on long-term economic growth and relationship that is so close to economic development and the well-being of the population. Studies are presented that show how innovation has given the nature of sustainability to the productive units at any level of aggregation. The importance of innovation stands out due to the benefits it brings, however, these have not been generalized worldwide, that is why the document discusses the gaps between compa-nies and between nations and the implications this brings with it. not only within them but in relation to the global context. In a topic that occupies the interest of both developed and developing countries, the role of international organizations in offering a theoretical and conceptual platform, as well as ma-king a statistical database available, is highlighted. It allows to deepen the study of innovation.
