As is known, the theme of the orlgln of power within the Church, and therefore of the relations between power and law, sacramental and juridical moment, and divine law and human law, has always enjoyed the particular attention of Doctrine. After the Council, this problematic has be en put forth anew -for obvious reasons- as a prior and fundamental presupposition upon which to establish the entire juridical structure of the Church in one way or another. The posture which is adopted to this effect either conditions, or is reflected necessarily, in the majority of solutions which are later suggested for concrete suppositions, situations, institutions, and so on. In this context we find the extensive and documented work of Piero A. Bonnet. In spite of frequent and personal observations, the author tries to offer, primarily, a general picture of the most recent doctrinal positions with regards to the subject at hand. Thus, according to the pursued object the work is systematically structured around the following chapters: 1) Traditional doctrine and the theory of the double origin of hierarchical powers within the Church; 2) The double line of ecclesiastical organization (Hervada and Souto) : 3) The doctrine of the complementary nature of powers (Morsdorf); 4) Bertrams and the doctrine of the unity of powers. Finally, in resuming the general problems mentioned in the introductory part, he expresses his own opinion on the subject, thus pointing out his particular point of view concerning previous doctrinal positions

Basing himself in a series of already published articles, Prof. Stickler underlines so me concrete forms in which, historically, the ecclesiastical power has been manifested. He considers that the Second Vatican Council has not solved definitively the question, and that there exists sufficient historical data to be able to affirm that the socalled power of jurisdiction has been understood as being distinct from that of order, and furthermore not predispcseci by the latter. There existed a bipartition of ecclesiastical power (order and jurisdiction). Such an affirmation is demonstrated by means of the analysis which Stickle' makes concerning the papal office, the episcopal offlce, the office of the archdeacon, etc. The awareness of such a distinction is clearly anterior to the Twelfth Century, contrary to what has been affirmed and accepted recently by a certain doctrinal sector. Stickler expounds upon the solutlon given to the question by the Decree of Graciano and his commentators, as well as by the rest of the Canonical Science, and he focuses his attention upon primatial power. His conclusion is clear: the essence of the primate, according to classic canonistics, resides in the power of government and not in a power of orden distinct from that of the bishops. From this he deduces the difference between power of order and of jurisdiction. Lastly, after reflecting upon many other points of connection with the theme at hand, Stickler Studies how the weight of the preceding doctrine in relation with the configuration of the ecclesiastical power was reflected in the Codex. He also studies the remaining theological problems, as well as the function of the historian in this matter.

In a brief synthesis, the author, voicing the critiques which have been made about the concordate norm, situates with precision the problematic which is put forward. He then summarizes the distinct steps which record, in Spain, the legislative evolution on the matter, and likewise shows the basic aspects of the educational system in the concordate legislation of other countries. After bringing to mind the doctrinal orientations of the Second Vatican Council, the author centres his attention upon the exposition of the Spanish episcopacy's point of view. With systematic rigour, he presents the position of the Spanish episcopacy in relation to the following three points: 1) religious instruction; 2) educational centres belonging to the Church; 3) the situation of equality between different educational centres, be they of the State or noto Given the complexity of the subject at hand –to which the author frequently refers- the work seeks with preference the suggestion of a possible skating of the case . In other words, the author do es not pretend to give solutions, but rather to illuminate the problem.
