Abstract: The author exposes the vicissitudes in the drafting of the new Honduras Criminal Code, particularly in reference to gender violence and abortion, and specially emphasizes how the unfortunate intervention of the officials of the United Nations High Commissioner and UN-Women, who lack sufficient training in the subject but plenty of arrogance, has prevented Honduras the adoption of progressive and adequate legislation in these matters

Abstract: The implementation of public hearings in judicial fora in the last decades has been considered from different perspectives one of the most important innovations in the practices of Latin American Courts. They promise a renovation in the ways of accommodating the tension between the role of Courts (especially their function of judicial review) and democracy; in the models of judicial decision making, and they point to the symbolic dimension of procedural rules and practices. This paper presents a study that tests the accomplishment of these promises tracing the impact of public hearings in the decisions of the Supreme Court of Argentina in the period between 2004 and 2017.

Abstract: The abolition of prostitution has been an objective and a historical demand of both the feminist movement and feminist political theory. However, the proposal of consideration as any other activity in the framework of labor relations, is now portrayed as an urgent regulatory innovation aimed, supposedly, at guaranteeing the rights of prostituted women. But this claim must be interpreted in relation with the transformation of prostitution as an activity, which currently represents a lucrative global market with systemic dimensions. This article analyzes the structural components of the prostitution system and the implications of its regulation on gender equality in order to evaluate the particular effects of its regulation in the German case.

Abstract: This text, which is part of a wider study about grace, analyses the relationship between legal mercy and public utility. After distinguishing between reasons of clemency or compassion, justice and utility, the essay examines separately, firstly, the two basic criteria that are able to justify legal mercy: circumstances of restorative justice and situations of necessity; and, secondly, the proceedings and authorities suitable for that mercy (amnesties and either general or particular pardons).

Abstract: I advocate here the thesis that there is a general right to conscientious objection based on the freedom of conscience, which means it is possible for a person to invoke conscientious objection to avoid performing a legal obligation even though there is no legal provision expressly recognizing to do so. A general right to conscientious objection cannot be interpreted in absolute terms. Conscientious objection in a particular case can only be accepted if certain requirements are met. I also examine those requirements: particularly the need to hold genuine convictions or religious beliefs and protect public order and the rights of others. Finally, I claim it would be convenient to regulate the most relevant forms of conscientious objection, and some suggestions on the matter will be proposed.

Abstract: This article reviews the political and administrative process that ended with the humanitarian pardon and the right of grace signed by the former President of Peru, Pedro Pablo Kuczynski. His decision favoured Alberto Fujimori Fujimori, who was sentenced for grave human rights violations committed during his mandate as the head of the Peruvian government in 1990’s. Some legal and political arguments, held by high legal officers of the Ministry of Justice and Human Rights warning the top authorities about impunity guaranteed by this decision, are revealed.

Abstract: The aim here is to address the ascription of solidarity to a complex conceptual constellation in which could be found such terms as altruism, compassion, empathy, fraternity, or even philantropy, trying to avoid at the same time what is implied by other words like benevolence, charity, pity, mercy or piety. Being a successor of everything symbolizing fraternity, solidarity itself cannot be enough in demand in a context where values related to the homo oeconomicus come first. That would be more the reason to revisit solidarity from the vantage point posed by enlightened values. Thus, going over Kantian concepts like autonomy and independence, joined those by Rousseau’s reflections on inequality, both seem to claim for an interdependence not tainted by aporophobia or promoting the lack of solidarity, but instead by the indispensable social justice.

Abstract: Conscientious objection is an instrument to solve the conflict between legal and moral duties. In democratic societies, it is easy to find different features and nuances to define it which are not always compatible among them (i.e. conscientious objection as a legal right vs. objection as a conditioned exemption to the law accomplishment). Depending on the guiding notion, the potential advantages and disadvantages arisen from conscientious objection regulation can be identified. These aspects are the central points which articulate conscientious objection issues, which currently are mainly related to conflicts between professional duties and personal beliefs.

Abstract: Human dignity is a central value for Culture of legality and in most legal systems enjoys the highest guarantees, because it protected against attacks that could reduce it and also because serve as basis for other human rights. However, abuse of the term in political discourse and its strong moral and emotional load become dignity concept of vague outlines. This paper recovers Kantian classic treatment of dignity and offers a contemporary reading that will help us to deal with current problems.
