Resumen
Trafficking in human beings for labour exploitation is still an under-researched manifestation of this phenomenon, also in terms of victim assistance. This paper, based on 34 in-depth interviews with victim service providers dealing with cases of labour trafficking, examines the remaining challenges in victim assistance in this field. Deficits have been detected in four areas and proposals have been formulated to overcome them: 1. Detection of trafficking and labour exploitation; 2. Victim identification; 3. Intervention program for labour trafficking and labour exploitation victims; 4. Victim compensation.

Resumen
In the last decade, Michael Pawlik has become one of the leading figures in the field of Criminal Law in Latin America and Spain, partly because of the way in which he has combined a deep philosophical analysis with a thorough approach to the specific problems of the general part of criminal law. This paper will try to show, first, how useful this methodology can be, based on a reconstruction of Pawlik’s analysis of the foundations of the legal figure of necessity (as an excuse). And, secondly, that his theoretical model has a much more important critical potential than even the author himself has recognized. In order to show the latter, a specific problem will be addressed: the restriction of legal interests that can be defended in a situation of necessity according to § 35 para. 1 StGB. In particular, it will be argued that Pawlik’s legal foundations, based to a large extent on considerations of theory of freedom, allow attractive conclusions to be reached both de lege lata and de lege ferenda.

This article analyzes and tries to demonstrate, from a dogmatic point of view, the possibility of considering the undue prolongation of benefit fraud as a permanent crime, contrary to the case law of our courts, which convicts for facts of prolongation of social benefit fraud as a continuing offence in accordance with the provisions of Article 74.1 CC.

Resumen
Reporting channels in the private sphere gained special importance as a result of the inclusion in 2015 of compliance programs as a cause of exemption/mitigation of the criminal liability of legal entities. Now, years later, the Spanish legislator is in the process of approving a whistleblower protection law that largely transposes the existing European regulations in this regard. To the analysis of these questions we will dedicate the present work.

Resumen
Since 2011, Organic Law 12/1995, of 12 December, on the Repression of Smuggling, recognises the criminal liability of legal persons in the offences against fauna and flora defined therein, thus theoretically —but not in practice, due to the absence of jurisprudential pronouncements— allowing the imputation of corporations. This normative reality makes the reform of the criminal code necessary, in the sense of including the liability of legal persons in the crimes of Chapter IV of Title XVI, in order to comply with the requeriments of the European Union and the reality of their commission dynamics as corporate crimes, demonstrated by the corresponding risk map, in terms of relevance, probability of occurrence and impact.

Last October we witnessed the withdrawal of the parliamentary seat of Alberto Rodríguez, who until then had been a deputy of Unidas Podemos. The loss of such condition occurs between the noise and confusion generated by the media, so these pages approach the succession of events from the legal technique to try to clarify what is the scope that the conviction from which all the controversy emanates could have and what extra-penal effects could be derived from it on the parliamentary status of the individual.
