Current legal theories that are contrary to legal positivism are necessarily associated with moral objectivism. They put true morality above positive legal norms and also above the constitution, and make true morality the authentic constitution. Since morality is the most important thing in the Law and morality is presented in the Law in the form of principles, there are no antinomies between the principles and there are no unfair legal principles.

This paper analyzes the criticism of Raz to Searle, based on the fact that the theory of constitutives rules of Searle leads us inevitably to consider all norms are really constitutives. We could say that even primary norms are constituting new realities, and the facts they regulate are per se institutional.

This paper addresses the debate relating to COVID passports as a tool to build a new normality. We wonder if these passports could be a foundation for creating conditions in civic rights and freedoms and, in turn, protect public health. Different proposals and positions are analyzed, and by doing so, verifying the legitimacy of COVID passports based on what we have experienced during the months of the pandemic. This idea evokes other health documents that are proliferating in the digital age: vaccination cards, genetic passports, and biological passports. Analyzing the corresponding debates, we observe that solid scientific knowledge could support a legitimation in labor court: the protection and improvement of occupational health. This analysis shows that these documents are a reality; for this reason, the labor legal system cannot remain on the sidelines, but it must offer a regulation that guarantees non-discrimination, protects privacy and data, and favors the personal autonomy of workers.

As a result of the debate raised by the extension of the notion of disability as a cause of discrimination to realities such as diseases of uncertain duration or situations such as obesity, this work analyzes the concept of disability from its design by international instruments for the protection of human rights, and tries to identify its constituent elements. On this basis, the reasons that allow receiving under the disability realities or personal situations not previously raised are explained; and a model of normative treatment of disability is identified, made up of measures of various kinds that, on occasions, can appreciate disability under different legal nuances and reasons. Finally, the incorporation and consolidation at the constitutional level of this conception of disability stablished at the international context will be highlighted on the basis of the recent Judgment of the Constitutional Court 51/2021.

This paper analyzes the new forms of discrimination for health reasons, cause the irruption of the SARS-Cov-2 virus in our lives, in the field of labor relations. We will analyze the protection mechanisms that our legal system arbitrates against these new forms of discrimination both in access to employment, as in the development of the employment relationship or at the time of its termination. Faced with the application of apparently neutral norms, discriminatory behaviors may underlie that towards certain groups of people. First of all, we will analyze how these discriminatory acts can violate other fundamental rights such as privacy, dignity or the protection of personal data related to health. Second, we will focus on determining when business decisions caused by the health situation of workers violate the principle of equality and non-discrimination. And, finally, we will analyze the classification of the dismissal based on causes related to COVID 19.

The protection of the external appearance of the worker, both physical and so-called aesthetics, is a controversial issue which has been analysed by our courts of justice, mainly on a case-by-case basis. What is true is that we are not faced with a peaceful issue in doctrine and jurisprudence, there are authors who consider that the right to one’s own image does not include what, from a strictly grammatical or semantic point of view, might seem: the right of each one to bear what he deems appropriate. On the contrary, it is considered that there are aspects that may limit this right under the exercise of the freedom of enterprise to organize human resources as a manifestation of the management power of the employer
