Some modern legal codes use “antichresis” to design a lien, mainly due to the interpretation given during the Modern Era to the two fragments of Marcianus mentioning the ἀντίχρησις. As difficult as laying an interpretation about the actual meaning of such term for Marcianus may be, the scholarship since the beginning of the XXth century has come to understand a set of compilatory and papyrological evidences under the same denomination of “antichresis”. This paper proposes an alternative reading of the only apparition of the word ἀντίχρησις in the papyrological sources of Roman time in P. Gron. 11. It provides also insight as to the peculiarity of the connection between the antichretic agreements and the guaranteed obligation.

Nowadays, procedural representation is the function performed by court attorneys in representing the parties in all types of proceedings. However, this figure is not a recent creation, as it dates back to Roman Law and, subsequently, to Castilian Law. To this end, this study analyzes, on the one hand, the figure of the personero as procedural representative in medieval Castilian law, specifically in the imposing text of the Siete Partidas; and, on the other, to what extent this figure is original or derived from its Roman predecessors, such as the vindex (in archaic law) or the cognitor and procurator (in classical law).

In this study, the way in which the primitive and original rigidity of the principle salva rerum substantia was moderated over the passage of time is analyzed. It is not only noted in the Roman legal sources themselves, which already showed a flexible development of the principle as a consequence of jurisprudential intervention, but also because of the necessary acceptance of the regulation quasi ususfructus. As a result of the reception of Justinian Law, examples of usufructuary may be appreciated in the current legal order that although not completely disregarding the principle salva rerum substantia at least highlight its absolute elasticity, in other words, its flexibility in adapting to the established legal order. Nevertheless, what is fundamental in the law of usufruct are the rights of the usufructuary, uti et frui, the limit salva rerum substantia being secondary, as it is variable and modifiable, although no less important for that reason.

Resumen
Among the institutional figures who defended citizens against the abuses of public authorities, the tribune of the plebs (for the republican period) and the defensor civitatis (for the late empire) are frequently mentioned with regard to the Roman experience. Itis not uncommon to consider them historical antecedents of the modern figures of the ombudsman and the defensor del pueblo. Beyond their common function, however, there are significant differences between the two Roman institutions. This contribution examines these differences in relation to their interventions in defence of the personal freedom of the citizen in the pre-trial phase, when the preventive detention of the summoned person is ordered.

It is paradoxical that the pactum de retrovendendo (used over the centuries as a credit guarantee) has not been widely discussed in the Roman sources, despite the fact that a mortgage system as solid as the modern one did not exist in Rome. Starting from this apparent contradiction, this paper aims to address the scope and effects of the pactum de retrovendendo with the target of explaining the causes of its limited use in Rome.

When a software is conceived to achieve a result that is known in advance, legal title to its source code is its legal keystone. Artificial intelligence allows to achieve a result without having to foresee it. This allows an « intelligent » thing inter alia to treat relevant data that cannot be known in advance. This evolution from determinist software to "intelligent" software heavily nuances the importance of source code. Determining what has been done by the contractor who has made someone else’s thing "intelligent" requires to focus on possession through animus and corpus then to distinguish appropriation by big data.
