Truth in the canonical marriage process avails of different meanings: factual truth, the real course of the marriage events presented for judicial examination; the doctrinal truth to be respected in the decision; truth with a legal dimension, i.e. which contextualizes the marriage in terms of the canonical discipline; and finally, as truth oriented towards spiritual salvation. The pursuit of truth is a recurring theme papal addresses to the Roman Rota, from Pius XII to Francis, and it is set out again in the Mitis Iudex Dominus Iesus: pursuit and service to the truth are key features of this latest revision of the regulation. Some institutions set out to guide this process towards truth: the appropriate understanding of contradictory positions; the primacy of favor veritatis in relation to both favor personae and favor matrimonii; the fundamental importance of moral certainty in the canonical process system; the recognition of the proof-value of the statements made by the parties involved, deferred to in a prudent and balanced way.

The recent Synods of the Catholic Church on the family (in 2014 and 2015) have highlighted the difficulty people may experience in understanding God’s plan for marriage. This article analyzes the legal elements that constitute the substance of Christian marriage in the light of the teachings of the last three popes (John Paul II, Benedict XVI and Francis). It shows that the Church maintains its traditional teaching about the natural character of marriage as an institution, affirming the possibility of «connatural» knowledge (as described by St. Thomas Aquinas). The mediation of postmodern culture may compromise our understanding of marriage as planned by God. The second part of the article applies the essential legal categories of marriage to some aspects of the reform of the matrimonial nullity process carried out by Pope Francis in the Motu Proprio Mitis Iudex Dominus Iesus in 2015.

Chapter 8 of Ap. Ex. Amoris Laetitia has given rise to different, sometimes contradictory readings. However, it cannot be said that the papal document extends Eucharistic communion to divorced people who have entered into new unions. Chapter 8 requires careful interpretation in altum (in full and in depth). The object of mercy is not only suffering, but first of all situation of sin; and the subject of mercy is not only the one currently experiencing misery, but anyone who may experience such fragility and misery in the future. Mercy implies that moral and legal norms be applied without any sense of cruelty, not that such norms be ignored. Marriage does not admit of indiscriminate analogical varieties, because it is not merely an ideal model. In the case of so-called irregular situations, reception of the Eucharist always requires the provision of a change in life.

This article focuses on the issue of understanding matrimonial indissolubility, a problem of key practical importance for the appropriate application of Mitis Iudex and Amoris laetitia. It aims to show that an adequate foundation of the indissolubility of marriage is not possible when justice is ignored. To this end, the article analyzes some of the common arguments in favor of the indissolubility of marriage (the goods of marriage, the role of conjugal love, the sacramentality of marriage) so as to shed positive light on the contribution of the idea of marriage understood as relationship of justice in order to properly understand its indissolubility.
