The statement of classic Canon Law as a legal ordinance with the coexistence of two legal systems (one of divine origin; the other human) is a mirror which reflects the relationship between the former legal ordinance and other secular laws. Using what Saint Isidore of Seville established in the Etymologies (VII century) as a starting point and finalizing with the Gratian’s Decretum (XII century), the historical evolution of intermediate Canon Law shows a unbroken line of thinking that emphasizes the subordination of all legal process to the Divinity, and, by extension, the superiority of ecclesiastical law over that law which is rooted in mankind. At this juncture, in this paper three contributions which lead to the formation of a universal canon compilation are examined: the work of Burcard de Worms (beginning of XI century), that of Anselmo di Lucca (second half of XI century), and that of Yvo of Chartres (XI to XII centuries), which clearly show, often veiling the political intrigue, the supremacy of divine order over human order and the resultant superiority of the former over the latter.

The author of this commentary wishes to draw our attention to some canonical problems posed by the instruction Erga migrantes caritas Christi. This is the first time that a Pontifical Council of the Roman Curia has published an instruction, that is, a general regulatory document without a previous papal delegation or the eventual posterior approval in forma specifica. This poses some questions on its legality. It also introduces some doubt about the canonical title by which the Pastoral document on migrants presents regulations which affect Eastern Catholics. Finally it comments on the changes in the instruction Erga migrantes on some officia and structures intended for the pastoral care of migrants.

This study presents some reflections on the figure of the magistrate in marriage cases, as an individual, as a bearer of justice, and in most cases as a priest. The labor of the magistrate is carried out amidst difficulties which have an effect on married life in the modern Western world and in the approach to some marriage cases. The magistrate must have a solid formation and be conscious of the special value of marriage, which is also considered a fundamental right of the faithful. The magistrate must particularly take into account the principle of favor matrimonii as an inspiration for the whole matrimonial canon law. He must undertake this labor as a ministry for truth and charity, keeping in mind the good of souls. There are important principles for the directive action of the magistrate in marriage cases. The criteria of the Pontificial Teachings of Pope John Paul II are particularly rich and informative on this subject
