The article describes and analyzes the relationship between how to present the claims of the tutelage and influence it generates in the judge’s decision. Standard wording of the claims of guardianship, based on the structural design of fundamental rights is prescribed, awareness of the principle of consonance, limited rationality of the judge, and the meta-legal principle of clarity and simplicity.

From the perspective of legal sociology, this article problematizes and analyzes the problem of the forms of government and the structure of social orden, as well as operational paradoxes in which these forms are stabilized. That is, analyzes the type of schemes that have been institutionalized to organize the “inclusion” operating in political life and in decision-making processes, particularly in the case of Chile, following the military dictatorship.

On March 25, 2015, the Mexican Supreme Court of Justice issued a decision related to the investigation of Mariana Lima- Buendía’s violent death. This judgment sets forth the first decision related to the femicide. The decision is also relevant as it recognizes the right of women to a life free of violence and discrimination, underlining the authorities´ obligation to investigate and to prosecute with a gender perspective and it also establishes an effort to recognize a comprehensive reparation based on human rights violations. The decision also opens several debates; as the scope of the constitutional parameter control, such as if it is appropriate for a constitutional tribunal to analyze, in detail, a prosecutor´s investigation, or the scope of reparations through a writ of protection (juicio de amparo). The decision shows that a judgment may constitute a form of reparation, and a guarantee for the right to truth.

The doctrine of conventionality control is the source of international obligations for all the authorities of the States parties to the American Convention on Human Rights. Yet, this doctrine is closely connected with domestic law. This article explores that relationship, both from a descriptive and a normative perspective. The first part explains how the origin of conventionality control is connected with the phenomenon of the constitutionalization of International Human Rights Law in Latin-America, which has taken place during the last thirty years. The second part argues that our understanding of the operability of conventionality control should depend on several norms and principles of domestic legal systems. Consequently, the article proposes a version of conventionality control that recognizes the existence of legitimate spaces of constitutional self-determination regarding how this doctrine operates at the state level.
