The paper analyzes the most important theories that have been proposed to justify the so-called crimes of implicit danger; that is, the criminalization of behaviors that, in general, unleash a risk of harm to indeterminate interests, although there may be particular circumstances in which this kind of conduct does not provoke such a risk. After a critical review of different proposals, this paper supports the perspective that understands these crimes as rebuttable presumptions. Although this approach has been supported in the past, the paper provides arguments that allow us to understand better its advantages as well as to respond to the objections raised against it. In particular, it is argued that the view of crimes of implicit danger as rebuttable presumptions can maximize the advantages of resorting to this legislative technique, since it exploits largely the benefits of rules, without substantially increasing its unfair consequences.

Resumen
The thesis of this paper is that sub-participation is a partnership. Most scholars argue that partnerships necessarily constitute legal entities and, therefore, sub-participation cannot be a partnership. This narrow definition of partnership, in our opinion, does not fit with the regulation of partnerships contained in the Civil Code, which expressly qualifies sub-participation as a “partnership”, despite the fact that it is not a legal entity. Sub-partici- pation, as typical internal partnership, enables us to recover partnerships as a pure contractual relationship, long forgotten by our scholarship.

Resumen
This paper endorses the claim that, within the Colombian legal order, there is no constitutional right to block public ways during a protest. Furthermore, there is no human right with such content in the Inter-American Human Rights System. Instead, authorities have a power, and in many cases, a duty, to unblock public ways, when this disproportionately interferes with other constitutional rights or goods.
