Cases of double sale of property are handled by the supreme court of this country with a diversity of interpretations of the Civil Code. Good faith and the correct systematic interpretation of articles 1135 and 2022 of the Civil Code are important aspects that have been overlooked over the years, despite being essential to provide a coherent solution to this problem.This article dives deeper into this issue. The author urges the development of good faith in the articles mentioned and challenges for good faith interpretation. To support his claims, the author further analyzes a variety of Supreme Court cases and appeals.

The aim of this paper is to analyse the so-called cross-border corporate reorganisations, which have the particularity of involving companies incorporated and existing in different countries, focusing on mergers and the redomiciliation of companies.To this end, the authors analyse the legal concepts of nationality and domicile of legal entities, mergers and redomiciliation of companies, the considerations that lead to the implementation of this type of operations and, finally, whether it is possible to carry out a cross-border merger and redomiciliation of a Peruvian company abroad according to the current regulations.

The article analyzes, from a legal and criminological perspective, the role of gender in the conception and application of the criminal justice system, throughout its different stages. As such, it starts by questioning the apparent neutrality offered by criminal law categories, built up and interpreted from an androcentric lens that excludes and devalues female experiences, interests and values.Through a critical literature review that studies the interaction of punitive and patriarchal power, the direct and indirect empirical effects, at a comparative level, of criminal laws, substantive and procedural, designed and applied without a gender perspective are exposed and analyzed. The author afifirms that legal practitioners that apply criminal law tools ought to do so in consideration with gender sensitivity, while formulas of alternative justice that decentralize the traditional punitive paradigm are devised.

Twitter recently celebrated its 15th anniversary. During this period, the platform has gone through several phases, culminating in a record number of subscribers and profits in 2021. Twitter is a household name all over the world and people know what it can or cannot provide, independent of the future growth that it may experience with new investments and updates. This article aims to verify two interrelated hypotheses, namely: the Spanish press already knows how to optimise the social network Twitter, as three decades have elapsed since its launch; and, secondly, the algorithm modification implemented by Twitter in 2018 has triggered a change in the positioning of the headers studied in this social network. In order to demonstrate both, the object of analysis will be conducted by a mixed approach through quantitative statistical processes (which will study the number of impacts and retweets and likes obtained), and inductive qualitative methods such as semi-structured interviews. This multidisciplinary approach will provide a more complete and in-depth analysis of the phenomenon. The research focuses on the period between 2018 and 2020, and addresses the participation on Twitter of the four main traditional newspapers (El País, La Vanguardia, ABC and El Mundo) as well as four native digital newspapers (20 Minutos, El Español, elDiario.es and El Huffpost). The analysis comprises more than 1.5 million tweets among the eight chosen newspapers.

The present article addresses media pluralism from a critical perspective, as a guarantor of attention to social and cultural diversity. The study focuses on deaf individuals, and an analysis is conducted of subtitles as one of the services that guarantees universal access to the contents offered by Spanish Radio and Television (Radiotelevisión Española, RTVE) for social and cultural diversity. Likewise, given the changes in audiovisual consumption in the form of streaming, and the rise of on-demand content, an analysis is not only performed of linear television, but also of live online and on-demand content. For this, a quantitative analysis was performed of a random sample of more than 5000 RTVE programs (2017-2018), to establish the number of subtitled programs for deaf individuals, their schedule, and the types of contents that included this service. Also, a qualitative analysis was performed on a sample of 72 programs distributed among the different channels belonging to this public corporation. Lastly, to evaluate the quality and suitability of the subtitles, an online survey was provided, which was completed by 183 deaf individuals who were users of the RTVE subtitles. Through this combination of methods, we were able to analyze and evaluate the cultural pluralism of RTVE through the subtitles provided for the deaf, associating it with the defense of the fundamental right of freedom of expression and social inclusion, values that must be guaranteed in democratic societies.

The strategic importance of the internet for television became evident in the early 2000s, even destabilizing its very concept and finally resulting in convergence towards a profound transformation of the sector. The introduction of global over-the-top (OTT) media services into local markets has led to strategic changes in multimedia groups. This study considers the subscription video-on-demand (SVOD) services of Atresmedia and Mediaset España, the two main traditional media organizations in Spain that form a duopoly in the country’s commercial television sector, with the aim of understanding and evaluating their positioning strategy in this market and the results obtained through the diversification of their core business. Based on an analysis of their content, price, and promotion policies and the results in terms of subscriptions and revenues, slight differences emerge regarding the strategy and scope of these two groups in their own environment in the sector. They compete for customers to achieve growth in the audiovisual market while seeking to retain a cross-media, multiplatform audience, as well as expand their core business of commercial linear television against a background of a reduction of advertising spend on television and the expected increase of hybrid financing models.

This paper describes the research published during the period 2011-2020 by five leading Spanish peer-reviewed journals of communication, aiming to identify the most common theoretical frameworks and standard theories. A statistically representative sample of the articles published during that period was systematically selected from the five journals of communication ranked as having the greatest continuity and impact according to SJR-Scopus: Profesional de la Información, Comunicar, Communication & Society, Estudios sobre el Mensaje Periodístico and Revista Latina de Comunicación Social. A coding protocol that includes 13 variables and 74 categories was defined and applied to compare the type of theoretical frameworks and the theories in the different subject areas observed. The results show that although almost all the papers studied have a theoretical framework, fewer than half are grounded on recognizable theories. Specifically, journalism and digital communication are the two subject areas whose articles frequently include standard theories: in journalism by the support of classical theories of communication (framing, agenda setting, journalistic professional cultures and roles), and in digital communication by the support of more theoretically dispersed frameworks. Theoretical frameworks developed by literature review are common in other subject areas (such as audiovisual studies, public relations and documentation).
