The author questions how to interpret the normative statements of private international law. He highlights the importance of solving “difficult cases,” according to hartian terminology. Jurists are faced with a complex activity that is made difficult using expressions outside the domestic forum that are not easy to mean. That is, given the specialty of the object language, the interpretation and application of international regulations normally presents a “difficult case” that requires the reformulator’s reasoning, weighing and proportionality of reasons, since it cannot be concluded only through a simple modus ponens., nor affirm that the right is already provided for. When interpreting, reasons must be given for making the final decision. In the case of international legal traffic problems, decision-making should never lack rationality, with the judge being the one who must carry out the most important activity: arguing. The conclusion reached is that although the final decision is important, the procedure to follow to reach that final decision is even more important.

The National Code for Civil and Family Law Proceedings has modernized insolvency proceedings for non-businesspersons,  introducing out-of-court workouts and ruling out the requirement for unanimous approval in court proceedings, even allowing  the judge to impose the payment plan if no agreement takes place, with the possibility of discharge to the debtor. However, the adoption of the United Nations Commission on International Trade Law (UNCITRAL) model laws of cross-border insolvency and on recognition and enforcement of insolvency-related judgments is necessary to provide the code with adequate tools for an efficient administration of insolvency proceedings with cross-border elements. This article explains the convenience of incorporating these provisions into the national code.

International commercial arbitration is an effective means of dispute resolution, however, in practice, we find arbitral procedures truncated by the action or omission of the defendant that prevents the resolution of the dispute raised, which translates into a denial of arbitral justice to the detriment of the claiming party. Through the dogmatic, case analysis and comparative method, the purpose of this research is to analyze some truncated arbitrations, their causes and consequences, to propose preventive recommendations that the parties can adopt to bring the arbitration process to a successful conclusion, that is, reach the solution of the controversy and thus contribute to the effectiveness and efficiency of arbitration as a method of dispute resolution.

We analyzed the relationship between the digital competence and attitude towards change variables is in the context of national universities in Lima, based on the interactionist approach. We wanted to highlight the effects of the use of technology on cultural transformation through the idea of change. For doing so, we implemented a non-experimental design was, showing that 57.06% of new digital assets users consider that their digital competence variable is “high” and, with regard to the attitude towards change variable, they show a particularly high rank: 58.3% at the “good” level. Furthermore, 38.65% perceived digital competence as “medium” and only 4.9% as “low”, relating them to an attitude towards change variable low level. The results were analyzed from Goffman's contributions (in the context of the so-called Palo Alto School), and can be interpreted as an impact of the new figure/ground interactions fueled by technologies, on the development of competencies and on new social representations in general.

Emotionality plays a pivotal role in shaping educational dynamics across diverse levels and modalities. The study's primary aim was to elucidate the emotional aspects inherent in the e-learning training processes of students enrolled in the Master's in Education programs, specifically those specializing in Linguistics and Literature and Basic Education at ULEAM's El Carmen Extension. The research employed a qualitative approach, with a focus on the phenomenological method. Data collection involved in-depth interviews and focus groups, and the subsequent information interpretation utilized categorization facilitated by the Atlas.ti software. The study's key findings underscored the significant impact of emotions on the educational experience, facilitating a transformative journey from fear to hope. Additionally, participants perceived the e-learning training process as a pathway to cultivating practical skills autonomously. Notably, they emphasized the importance of being cognizant of the presence of others in the virtual learning environment.

In recent times there has been a substantial change in the role played by cities as spaces of cultural influence, transfer and social inclusion and as catalysts for the economic development of regions and even countries. The existence of university orchestras contributes to the obvious enhancement of culture in cities by encouraging citizen participation in artistic and creative activities. The aim of the study is to describe the cultural and socio-economic profile of European cities with university orchestras. Among the main results we highlight that most of the cities that have university orchestras have been named cultural or creative cities, have a high economic development and an outstanding cultural vitality. We conclude from this analysis that university orchestras function as one of the agents of cultural transfer and dissemination, actively collaborating in the economic and cultural development of cities.

Community-based tourism in Ecuador offers attractive opportunities for communities depending on one or a few low-impact economic activities. However, the experiences in Ecuador are so diverse that it is not possible to establish clear diagnoses. We proposed to classify sustainable tourism models and estimate their impact on the community, in the frame of Public Policy theory. The chosen method was documentary and entographic, allowing the triangulation of different direct and indirect sources. Variables were organized on diagnostic interests according the impact on community social change, the ecological and the economic sustainability. The data collected showed that there is a consistent gap between the intention in the design of the models and their implementation, in addition to the fact that it is not possible to obtain sufficient official information to conclude aspects related to the role of the community and the environmental aspects involved.

The present study was developed with the objective of analyzing the perception that teachers have of their performance in relation to curricular changes. As for the methodology, it was oriented to the qualitative approach under a case study design; the interview was used as a collection technique. As a result, teachers feel that the constant curricular change demands a lot of time and undermines their willingness to manage activities, due to differences in conceptions that they understand as adequate and that are subject to traditional education. As conclusions, it was detected that teachers' perception leads to a negative experience that affects their professional practice and develops in conditions that prevent them from actively participating as creative managers of the teaching process. The main value of this article is to promote the monitoring of the curriculum as a guideline for the current educational process.

Motivation is a key element in the teaching-learning process. There are many studies that address the factors that affect the interest that students show in the classroom for academic issues. However, we often forget that this element must also be present in the teaching staff. If teachers are unmotivated in their profession, it is very difficult for students to be motivated.   Through this study we intend to show the importance of motivation in the teaching profession. For this purpose, we have carried out a descriptive pilot study to determine the degree of motivation shown by Physical Education teachers and the causes that influence it. The study was carried out in primary schools in the city of León (Spain). The results showed that there is a good emotional regulation among this sector of the educational staff, being the most veteran teachers the ones who know better how to face the problems that can lead to a degree of demotivation. Psycho-educational involvement with students and professional promotion and commitment to education is one of the factors that most motivates the teachers surveyed. On the other hand, although to a lesser extent, the presence of students with psychomotor deficiencies requires greater emotional self-regulation in the teacher due to the readaptation he/she has to make in his/her Physical Education classes.
