Once again, litigation is being conducted before the Spanish courts as a consequence of the employment relationship that links the airline Ryanair with its workers, this time a cabin crew member. Following in the wake of previous judicial decisions, both the Labour Court and the Superior Court of Justice consider that the labour contract is governed by Spanish law in order to grant greater protection to the worker. For that purpose, the Court carry our a protective interpretation of the clause of choice of law contained in the contract, which initially subjected it to Irish law.

In this case, the Court analyses the possibility of granting the arrest of a ship for a debt produced by the lessee, not the ship-owner. The arrest is denied since the claim is not considered as a maritime claim that enables the arrest of ship under these circumstances.

The position held by the Italian case law concerning public policy in transnational family law matters has recently experienced some interesting developments, showing an enduring ambiguity between two different notions of public policy for the purposes of private international law, between a “truly international” conception of public policy, whereby it should be considered as purely limited to internationally shared legal principles, concerning especially the protection of fundamental rights, and a more traditional notion. According to the latter notion, public policy for the purposes of private international law shall be considered as embodying mostly national principles, identifying the fundamental attitude of the country at the relevant time, as reflected non only by its constitutional rules, but also by the rules embodied in domestic legislation, insofar as these translate into concrete rules the general principles embodied in the national constitution. Some recent judgments by the Italian Court of Cassation and Constitutional Court concerning topical issues of family law, with particular regard to surrogate motherhood, full adoption by same-sex couples, and repudiation, are particularly telling of this state of affairs. As the author proposes, the dichotomy between the said two notions of public policy for the purposes of private international law is likely to be overcome by suggesting a more flexible reading of the traditional notion, likely to encompass within its scope also those internationally shared legal principles concerning fundamental rights, embodied in the different notion mentioned above, with particular regard to the protection of the best interest of the child, as well as of gender equality.

En esta contribución se da cuenta de la distinta comprensión acerca de la exigencia de la propuesta previa de la entidad pública cuando se trata de una solicitud de adopción en España de un menor marroquí sujeto a un acogimiento familiar en virtud de una kafala constituida en Marruecos. La aplicación del mandato del art. 19.4 LAI que prohíbe la constitución de la adopción en España cuando la ley personal del menor no contempla esta institución resulta relevante para el correcto encaje de la discutida exigencia de la propuesta previa. Fuera de las excepciones previstas en la propia norma, no cabe constituir la adopción en España en estos supuestos.

In view of the ECJ and ECtHR case law on the recognition of names, same-sex marriages and parent-child relationships established abroad, this paper explores how various Member States conform with the resulting obligations. We compared 16 EU jurisdictions and their implementation of the aforementioned case law. Overall, a general tendency in favor of the recognition of a status acquired abroad can be observed; be it by the re-shaping of procedural recognition and private international law rules, or the application of new techniques, or an increasing restraint to reject recognition due to public policy reasons. Irrespective of the technique, however, a methodological struggle to comply with the European obligations is evident. Consequently, the mere registration of a status acquired abroad proves to be of increasing importance in practice.

In C-581/20, TOTO, the CJEU was asked about two key aspects of the Brussels I bis Regulation jurisdictional regime for interim proceedings. One is whether it is possible to apply for the same provisional measure before the courts of two Member States. The other is whether access to interim measures throughout Article 35 is subject to a European autonomous regime of prerequisites. To the first point, and against the Advocate General Opinion, the CJEU replies that such practice is allowed. Concerning the second point, the CJEU does not even clarify whether there is an autonomous regime of prerequisites exists or not. The CJEU’s answers are less ambitious than the expectations generated by the preliminary reference. This paper offers a comprehensive analysis of the judgment TOTO, evaluating its impact on the interpretation of the Brussels I bis Regulation.

Este trabajo tiene por objeto de estudio el marco normativo aplicable a los extranjeros menores de 18 años que acceden a territorio español no acompañados por sus tutores legales, la determinación de su edad y la validez del pasaporte u otros documentos identificativos expedidos por las autoridades de su país de origen. El punto de partida de este estudio es la sentencia de la Audiencia Provincial de Madrid de 27 de julio de 2020 que sirve, finalmente, para desmenuzar la doctrina jurisprudencial sentada por el Tribunal Supremo en orden a determinar la edad de los ciudadanos de otros países que llegan a España de forma irregular y, en consecuencia, si se trata de menores susceptibles de encontrarse bajo la protección que otorga la Ley y el Reglamento de extranjería.

The private international law public order of Romanian law in the field of family relations is found in the provisions: of the Romanian Civil Code (contains provisions of substantive law and provisions of private international law), but also in the provisions of the Code of Procedure Civil (as we will exemplify and exemplify during the present study); in a series of provisions of European law (especially European regulations, of immediate, direct application and with priority in the legal order of the Member States) but also the provisions of private international law throughout the world. Later we will analyze the particularizations of public order with an element of foreigners in the field of family relations in the texts of the Romanian Civil Code in Chapter II called „Family” (article 2585-article 2612) of Book VII, entitled „Dispositions of private international law” (article 2557-article 2663) but also of a series of European regulations in which the provisions of the Romanian Civil Code largely find their correspondence.

En su sentencia en el asunto C-73/20 el TJUE se pronuncia de nuevo sobre la interpretación del artículo 13 del Reglamento 1346/2000, sobre procedimientos de insolvencia (artículo 16 del Reglamento 848/2015, actualmente en vigor), esta vez en relación con el artículo 12 del Reglamento 593/2008, sobre la ley aplicable a las obligaciones contractuales. La conclusión del TJUE asegura el cumplimiento de los objetivos de ambos textos reglamentarios, garantizando la seguridad jurídica de los  beneficiados por el acto perjudicial que actuaron de buena fe.

This study examines the legal nature of digital video games, a good that is the subject of potential consumer litigation and with a marked international character due to the current global market. It will be analysed in terms of their nature as intangible goods, consumer protection in the European Union and then, using the verdict resulting from the dispute between UFC, a French consumer association, and VALVE, owner of the Steam platform, the main aspects to which consumers are subject in their terms and conditions of use, with special emphasis on the resale of these video games, the competent courts in case of litigation, out-of-court solutions and applicable law in these contracts.
