Resumen
In the French legal system, recognition of status is a classic issue that attracts diverse responses, depending on the circumstances, from procedural recognition of judgement to conflict of laws and conflict of authorities. In the light of this classic scheme, many foreign statuses are recognised in France without any difficulties, provided that they were legally obtained abroad. However, many obstacles to recognition remains and the current changing legal context in favour of a new subjective right of free movement including the status of persons, has been provoking active academic discussions among French scholars and unprecedented judicial developments. For these reasons, it is important to rethink globally the issue of recognition of status in a broad perspective within the French legal order.

Resumen
The case law of the CJEU and the ECtHR enhances the recognition of a status acquired abroad. The German legislative and judicative have consequently reacted, especially in the field of international name law. While the case law of the CJEU has fundamentally changed private international law approaches, the case law of the ECtHR so far has only been considered as a part of possible public policy arguments. Regarding the CJEU law, courts have developed a sophisticated system to “recognize” a status according to the theory of renvoi en bloc. This report describes how the aforementioned case law has changed and is changing the private international law methodology and practice.

Resumen
CJEU and ECtHR case law generally oblige the EU Member States to recognise a status acquired abroad. This report shows in detail how Austrian law complies with this obligation and how ‘recognition’ is ensured in Austrian practice. Two general observations can be made: First, public policy considerations and the recognition of foreign administrative decisions and certificates (e.g. birth certificate) play an increasingly important role. Second, whereas much attention is paid to the result, namely the (non-)recognition of a status in Austria, methodologically sound arguments and justifications are missing in practice

Resumen
Recognition of status is becoming a more and more important topic in private international law. New methods develop as case law of the CJEU and ECtHR strengthens the recognizability of a status acquired abroad. This development is also seen in Croatian legislation and is elaborated in the Croatian legal theory, notwithstanding the fact that the Croatian legal system was so far not in the focus of the CLEU’s or ECtHR’s case law. This report demonstrates the current state of play and recent developments concerning status recognition in Croatia.
