Resumen
Brief refiection on thevarious interpretations that are being made on article 315 ofthe Peruvian Civil Code, because the position of the relative jurisprudence, related to considering the referred article as grounds for nullity of the legal act due to the lack of manifestation of will of the agent, is being questioned in terms of doctrine. The text approaches us to the notion that the lack of participation of the spouse in acts of disposi tion of the join t property is notan infringemen t of the hard cor e of the Legal Act because of a lack of manifestation of will; instead of this, properly speaking it would grounds for inefficiency.

A judgment issued in Peru in 1917 related to an act of adultery with singulars characteristics: the judge recognizes that the ruling stipulates to criminally punishthe adultery, however he does not agree with the mandate for the reasons set out on his judgment, and absolve the defendants. Resumen
After the enactment in the year 2008 of the law which regulates the non-contentious procedure of the conventional separation and subsequent divorce in municipalities and notaries (Law 29227), the passing of time has shown us that despife the cited regulation represents a progress in the treatment and prompt solution to the problem of the conventional separation, there are also sorne Jactors and gaps in the application of separation that have not yet been corrected.

Resumen
One of the institutions of the Family Law with less presence in our courts, is precisely the Council of family; there are several reasons given for little application since the apparent demise of the compound and extended family, the regime way which the institution has been regulated, as well as its patrimonial vision; however,the institution was created to fulfill an important role within the context of the family,and we should aim to it. This work aims to develop the knowledge of the institution, its functions and objectives, all within the regulation which brings the Civil Code, and without making criticisms and recommendations for ensuring the effectiveness of the institution.
