Resumen
Through the physical efficiency tests, it is determined how the students' development is behaving during the course and, based on these results, actions can be taken to improve their trajectory. Flexibility is the physical capacity that gives man the possibility to perform movements of great amplitude, conditioned by the neuro-myo-articular structures of fixation and stabilization, and when cooperative work is used, the success of an activity of one member depends on the success of the partner. In class observations and interviews with the students of the first year of the Regular Day Course of the Physical Culture career, it is corroborated that in the Physical Efficiency Tests (Pef in Spanish) carried out at the beginning of the course, the level obtained in the physical capacity Flexibility, with respect to the rest of the tests, is the most difficult and very marked in the males, in addition, the variety in the classes and the little use of cooperative work are insufficient, so the objective of the work is aimed at proposing a set of cooperative activities that favor the physical capacity Flexibility in the students of the first year of the Physical Culture course of the Physical Culture and Sport Sciences University (Uccfd in Spanish) "Manuel Fajardo". The inductive-deductive, analysis-synthesis, scientific observation, survey and specialist criteria methods were used. The results were positive for the students after four months of applying the proposal. The specialists assessed the proposal as Very Adequate, which is evidenced by the students' results in the improvement of the level in the flexibility test.

Resumen
The incorporation to working life is not considered the end of the training, but a process of completion and development of the acquired skills to face the new working stage. Knowledge of the results of learning during the years of study is the basis for the design of this development plan in its first stage. Job training is the second stage of training and, undoubtedly, the most important of the whole process; its purpose is that the different figures appropriate the basic educational and technical elements they require to be able to start their specific work efficiently. Physical movement as an activity of man in his development evolved with the passing of civilizations, which allows Physical Education teachers to become aware of the need to study the social components that regulate physical activity and act in accordance with the characteristics of the individuals working at different levels or age groups. Hence, the objective of this research is aimed at proposing actions for the strengthening of the labor training of novice Physical Education teachers in the Boyeros municipality. Different theoretical methods were used like, inductive-deductive and analysis of documentary, as well as empirical methods, as observation, interview, methodological triangulation and psychological techniques for the implementation of actions to eliminate the difference between the current situation and the desired one.

Resumen
Transnational corporations (TNCs) have great political, economic, and legal power around the world, supported by a structure that protects their interests, situation that is clearer when TNCs"™ activities have adverse impacts on human rights. This has been proven in cases such as Chevron and its effects in the Ecuadorian Amazon region, or the collapse of the Rana Plaza building in Bangladesh in 2013.
Against this background, the international community recognized the need to fill the legal vacuum in regard to TNCs"™ activities, and two main frameworks were created. First, the Norms on the Responsibility of TNCs and other Business Enterprises with regard to Human Rights (2003), which were never formally adopted; and the Guiding Principles on Business and Human Rights (UNGPs) (2011), which are strictly voluntary. Afterwards, in 2014, the UN Human Rights Council acknowledged the indispensability of a legally binding instrument regarding human rights and TNCs, therefore, creating a specialized working group for this purpose.
The aforementioned efforts are part of the International System, which raises the following questions: Are regional bodies addressing this issue? Do any of the regional human rights instruments have dealt with it in any way? The focus of this paper will be to compare and contrast existent human rights regulations related to transnational corporations"™ impact on human rights, focused on the European and the Inter-American regional systems.

Resumen
This article analyzes the jurisdictional mechanisms designed in the Constitution of Ecuador to protect rights against non-state agents. It reviews the legal and jurisprudential development of the five causes of activation of the writ of protection against individuals: when they provide public services, generate serious damage, or place the person in a state of subordination, defenselessness, or discrimination. In addition, it seeks to identify practical cases in which the violation of rights committed by private parties enables its constitutional review.

Resumen
The article analyzes from a constitutional perspective the restriction of access to adoption in homoparental families in Ecuadorian legislation. The objective is to illustrate the incidence of this restriction on the constitutional right of children and adolescents to have a family, and how this provision is discriminatory with respect to same-sex couples. Theoretical and jurisprudential sources are examined on the types of families and the rights that their recognition implies. The results of the study indicate that this normative provision not only constitutes a violation of the right to equality and non-discrimination for homoparental families, but also affects the principle of the best interests of the child. As novel conclusions, the need torecognize and regulate adoption in homoparental families is proposed, and the criteria to be observed to regulate this type of adoption in Ecuador are also exposed.

Resumen
The supremacy of the Constitution, alongside other factors that belong to the constitutional transformation of the legal systems, serve as the fundament and the reason of existence of constitutional justice. Strictly speaking, constitutional justice is not but the guarantee of thesupreme position of the constitutional text and, at the same time, of the rights enshrined in it, within the standpoint of a new constitutional paradigm, as the “new constitutionalism” is. From these considerations arise certain problematics that have legitimate reasons of being, and which state that the attributions conferred to the constitutional tribunals or courts to serve as the guarantee of the constitutions, can inflict damage to the exercise of functions of the state branches, undermining principles as the separation of powers, as well as the democraticlegitimacy of the most important branches of the state. The foregoing calls for considering a new perspective of civil participation in constitutional decision-making.
