Referring to the background of judicial reform published in the Official Gazette of the Federation on September 15, 2024, and then the main characteristics of the reform are examined: the popular election of the judges and the Judicial Disciplinary Court, with the adverse implications that it will have for the independence of the judges to the detriment of this guarantee for human rights.

This study examines the evolution of the National Entrance Examination for Upper Secondary Education (EXANI-I) in Mexico between 2012 and 2022. Through descriptive analysis, three dimensions are addressed: test-taker participation compared to middle school graduates and upper secondary school enrollment; examination implementation by state; and the social and economic profile of applicants. The results show limited and unequal participation relative to the target population, with a declining national trend. Marked state-level differences and changes in participation patterns exist. The gender gap, previously favoring men, reversed after the pandemic, increasing female presence. The proportion of test-takers with parents who speak indigenous languages and from middle socioeconomic levels also increased. The study provides useful evidence for designing more objective, inclusive, and transparent admission processes.

Critical thinking is a skill that has been fostered over the last decade in the educational setting, with the purpose of training analytical and deductive students in the classroom. Therefore, the didactic strategies employed to promote it at the secondary and high school levels in Latin America between 2020 and 2024 are identified. A methodology based on the PRISMA statement was used, while the search was conducted in the Dialnet, Lens.org, Redalyc, and Scielo databases. Exclusion criteria were applied, and 32 articles were analyzed. It was found that the most frequently employed didactic strategies are those that foster exclusively cognitive-analytical skills, while didactic strategies that stimulate emotional, critical, and social skills are less applied. The findings indicate that, to develop and promote critical thinking in secondary and high school students in Latin American classrooms, it is necessary to contemplate the creative-emotional dimension of critical thinking identified in this work.

This study analyzes the alignment between competency-based curriculum and learning assessment in subjects within the Music Education program at UNAN Managua. This is a descriptive correlational cross-sectional study using a questionnaire applied to 100 students and 12 faculty members. The study found moderate alignment, with strengths in technical competencies and weaknesses in formative feedback; faculty experience influenced the use of rubrics. However, the study design and voluntary participation restrict causal inference, suggesting the need for longitudinal and observational replication. Nevertheless, it provides recent evidence on competency-based assessment in music within an understudied Latin American context and offers indicators for institutional improvement. The study recommends strengthening faculty training in formative feedback and redesigning rubrics to consolidate curricular alignment.

Education has been transformed today with the rise of hybrid or blended formats and the decline of the in-person model. Educational research tends to compare the results of both modalities. Therefore, the objective of this article is to analyze learning assessment in teacher training in Uruguay, considering the perspective of professors and students in this regard. It is a case study with a mixed approach; it combines qualitative and quantitative methods through interviews and documentary analysis. The results reveal that the in-person modality has a greater impact on learning, a perception shared by teachers and students. To address this disparity and promote inclusion, it is recommended to strengthen the blended modality with smaller groups. It is also necessary to implement a Spanish language skills assessment for admission to the teaching program, as crucial measures to align expectations and improve educational quality.

The reform in the area of labor justice with its consequent reform of the Federal Labor Law has generated a re-evolution of social law. The implementation and operation of mandatory prejudicial conciliation by the Federal Center for Conciliation and Labor Registration and the Labor Conciliation Centers has not been an easy task. Various questions have arisen in its implementation and operation, as well as in relation to the cases in which it is not necessary to exhaust the prejudicial conciliation procedure, which are the object of study of this work based on the theory of law, the contentious cases that have been submitted to the resolution of the jurisdictional bodies, the applicable regulations and their possible reform, in order to eradicate the inconsistencies and omissions of the prejudicial conciliation procedure established in compliance with the Treaty between the United Mexican States, the United States of America and Canada (T-MEC) to access prompt and complete justice in the administrative and jurisdictional spheres.

This article examines errors in the jurisprudence of Colombia’s Constitutional Court and the Supreme Court of Justice concerning the concept of ius variandi locativo, highlighting discrepancies with legislative intent. It begins by defining ius variandi and contrasts it with other legal concepts to delineate its limits and legal foundations. The discussion includes an analysis of geographical limits and the implications of exceeding or misusing ius variandi locativo. Additionally, the article reviews the handling of general and abstract clauses and the allocation of the burden of proof in these contexts.

The activity of environmental expert witness has considered the knowledge of the communities to “illustrate” to judges the environmental crimes in a judicial process, particularly in the case of socio-environmental conflicts. But it is not usual in those environmental expert witness that are disciplinary, for example; toxicological or chemical expert witness. However, given that ecosystems, which are the object of expertise, are complex systems in which relevant scientific uncertainty has to be faced, the knowledge of the communities affected in their health by damage to the ecosystem may be an alternative to accompany the expert evidence. This paper shows how the knowledge of a community affected in its health, in a semi-urban area due to the disposal of wastewater into the ecosystem, corroborated with scientific knowledge from other geographies, helped a Federal Judge in a socio-environmental conflict to operationalize the Precautionary Principle into impoverished context for pursuing environmental justice.

This article explores social human rights in the context of migration in the Americas, analyzing the international and regional instruments that protect these rights. It addresses a conceptual framework on social human rights, their evolution, and the importance of guaranteeing access to them for migrants. This analysis highlights the responsibility of States to adapt their national legislation and policies to protect these rights, in order to ensure real and effective protection for all people, including migrants. It also highlights the importance of the legal argumentation of judge Sergio García Ramírez in generating international jurisprudence on the subject.

The present work, taking as a reference the issue of indigenous peoples in Latin America in recent years, has as its main purpose to expose how interculturality, understood as a model of diversity management, an emerging paradigm, an ethical-political project, and even as a way of life and a national project, has been reflected lately in the jurisprudence of the Inter-American Court of Human Rights in relation to the protection of the rights of these peoples. In this sense, we consider that interculturality has been manifested in two ways. The first, implicitly contained in a series of standards that have been applied and perfected in various resolutions in favor of these peoples, such as the right to a dignified life, protection of communal property and the right to prior and informed consultation. Second, more explicit and pragmatic, has been through what the international court itself has called the “intercultural method”, by means of new and sophisticated ways of administering justice breaking with the traditional scheme.
