Resumen
The general objective of this scientific article is to analyze the lack of declaration of insolvency existing in the Ecuadorian legal system and the possible violation of patrimonial rights to the creditor. The problem arises because article 416 of the General Organic Code of Procedures establishes that when the debtor does not comply with the execution order ordered by the judge, only the presumption of innocence is contemplated, in this sense it does not occur as in other legislations, that if the debtor does not comply with the execution mandate automatically, in the first place the insolvency is declared by the court of the case, and secondly the debtor can immediately execute the debtor's assets. This problem has caused a lot of discussion because those affected are of the criterion, that their credit is not guaranteed. The methodology used was based on the qualitative approach and for this purpose a comparative analytical method was used, since in order to provide a solution to the problem, provisions of Colombian, Peruvian and Chilean legislation were consulted, in which if there is a precise solution in relation to the problem posed in this investigation. Finally, this article made a proposal to modify article 416 of the COGEP, in order to protect the rights of the creditor and to decree the insolvency of the debtor at the time of not complying with the execution mandate derived from the competent court

Resumen
The present research work analyzed whether or not there was a correct application of the Ecuadorian Legislation in accordance with Articles 46 Transcendental attenuating circumstance and 293 Extralimitation in the execution of an act of service within the case No. 06282-2021-01091, and also considered what were the substantial grounds considered by the Court of Criminal Guarantees of Riobamba when issuing its sentence.
As this is a qualitative, descriptive study, it is intended to provide a broader perspective on the use of firearms and other types of force used by the police officer Santiago Olmedo against the criminals on June 11, 2021; and through a documentary review of the sentence of case No. 06282-2021-01091, it is also considered what were the substantive grounds considered by the Court of Criminal Guarantees of Riobamba when issuing its sentence. 06282-2021-01091, it will be concluded with the observation of the correct application and severity of the norm, from the approach of the actions of the police officer in a criminal act, and the high degrees of violence that they are forced to handle by the criminals.
It is concluded that there is an inaccuracy and lack of judgment, since the police officer made an inadequate use of force and exceeded the margins established by law and the regulation of the Legal, Adequate and Proportional Use of Force for the National Police of Ecuador, since there should be a fair treatment and rigidity of judgment for police officers.

Resumen
The social media of the education sector has an accelerated evolution during recent times, especially since the covid19 pandemic, however, there are shortcomings in the application of marketing strategies. Preciselythis article seeks to determine a model of Social Media Plan for educational units, where appropriate digital marketing strategies are applied for the good management of social networks, based on the case of the U.E.G. V. (Giorgio Vasari Educational Unit).
In this article, through the analytical information of the digital platforms, the management of the social media of the institution under study and its competence was diagnosed. With interviews with the appropriate people of the institution, the qualitative data was obtained, the shortcomings were detected, and the appropriate strategies were designed for the proper functioning of the Social Media Plan to be implemented.
The results obtained indicate that educational institutions must improve their presence in social networks, since the metrics analyzed show little reach and growth in their platforms.
The demand of customers in the education sector requires the correct application of marketing strategies, which will allow the advancement of the digital world to go hand in hand with its growth and for the present case to position the Giorgio Vasari brand and make it a leader within the educational sector of the city of Portoviejo.
