Resumen
This article focuses on the relationship between technological capability accumulation and the learning underlying processes in AGCO (1970-2000) – a producer of harvester machines. The framework for capabilities identifies three technological functions: processes and organization, products and equipment. The learning processes are examined to the light of four characteristic: variety, intensity, functioning and interaction, from the structure existing analysis use in the literature. Based on an individual case-study, this article draws on first-hand qualitative evidence collected through fieldwork. The evidence points to a strong association between the learning processes used in the company and the manner in which the company accumulated its technological capability over time.

Resumen
Companies that see technological innovations as privileged instruments for their strategy should get prepared to create and manage ideas on systematic bases. An important source of ideas is the workforce since there is a system enough to stimulate creation of ideas. The suggestion systems created for that end turned into important tools for the quality movement and for that reason they became strongly related with incremental innovation. Thus, such systems were hardly forgotten by the dominant literature on technological innovation. Few people have analyzed them as a means of creating an environment favorable to all sorts of innovations and as knowledge management instruments. Firstly this paper presents a briefing bibliographic review about suggestion systems, highlight the main challenges of creating and managing ideas in quantity and quality compatible with an innovation-based strategies. After, the paper presents a case study on a Brazilian company that has attained an average of 34,3 ideas per employee per year. It is a very expressive number under any criterion, close to the current average of corporate leaders in Japan, according to the National Association of Suggestion System. The study draws attention to the importance of point out the management of the suggestion systems, the fitness to overall organization management system and the outputs reached.

Resumen
It is possible to say that the results of technology innovation efforts in a company are due not only to technical skills, but also to organizational (internal view) and relational (external view) competences. The knowledge of relations among actual competences and the potential of results generation can be an important element to the definition of corporate strategies.This work discusses these relations based on the way in which innovation competences, performance indicators and technology positioning of a Brazilian petrochemical company have evolved from the early 1990s up to 20002. It has been found that the competences (and their use) and the indicators have increased simultaneously. In some cases it was possible to identify a cause-effect relationship. It was also found that the increase in competences and their use contributed to an evolution, even though it was not intentional, of the company´´´´s technological positioning.

Resumen
Environment issues have induced firms to search and develop cleaner technologies and production practices. This process has created new business opportunities that are related to sustainable production and to the conservation of the environment. This paper aims at understanding the implications of innovation trajectories based on the development of sustainable products and technologies for innovation management practices and the related managerial competencies. The study explores the case of a Brazilian leading cosmetic manufacturer - Natura through secondary data of the company and its industry; and primary data by means of interviews with professionals of the research and development, strategy and marketing areas of Natura. The results show that the company presents a capability of perception of the technological and market opportunities when developing products for market niches not explored, besides the effort for implementating routines entirely new for the company and the mobilization of resources and competencies in its technological innovation management.

Resumen
Is the interpretation according to the Constitution a species of constitutional interpretation being that laws are interpreted according to the Constitution? To force the judge to save the law of an unconstitutionality will not produce, in opposition to which may be thought, greater friction between the legislator and the constitutional judge? With these questions the author critically analyzes both foundations of the interpretation according to the Constitution, the unit of the legal ordering and the presumption of constitutionality of the law, to conclude that analyzing legal institution can be seen as a result of a double triviality: what is good for Germany is good for Brazil and the respect to the legislator is a common place, since what makes the judge constitutional is to make compatible the law with which the own judge, and nobody more, thinks is constitutional. It concludes maintaining that the only function it has been left to the interpretation according to the Constitution in Brazil is the one to subtly legitimize the centralization of the interpretative task of the Constitution and all the laws in a single court, excluding itself any "interpretative disobedience" from the judicial organs.

Resumen
In the present work the figure of amicus curiae is approached from a perspective of comparative law, with particular reference to the Argentine law where without an Act that institutionalizes it generically, it has come to qualify and to regulate the intervention of "Friends of the Court" in the causes submitted to its jurisdiction. The author crosses basic lines of this institution, transformations from its early conformation to the present time and the perspective and potentialities that offer in internal law as well as in international instances, in order to help the defense of due process and to transparent and to democratize jurisdictional debate around complex questions or with social interest where the sentence to be dictated has expansive effects, that is to say, it projects beyond the real case and acquires a strong collective importance.

Resumen
To elaborate a new Constitution in order to conclude the process of democratic transition is the main premise of this article. The author analyzes three proposals of integral amendment to the Constitution and displays his own constructed in four planes: legal-formal, legal-material, historical and political, not seeing any problem regarding intangibly clauses nor with dual procedures of constitutional amendment. The merit of the proposal, indicates the author, is based on democratic legitimacy that is reached with the popular participation through a double referendum: to decide having a new Constitution and to confirm the results of the Constituent Assembly, every time the original Constituent is only the people and Constituent Assembly its instrument.

Resumen
In legal culture reading and listening of conflicts between fundamental rights to mean those cases in which a fundamental right is faced another fundamental right is very common. This figure almost universally accepted today is put into question in the present essay. Doctrine conceiving rights as realities that may be in contradiction is analyzed in order to criticize not only its philosophical-legal postulates, but also the solution mechanisms that propose the referred doctrine. New interpretative criteria of constitutional rights are also proposed so that instead of appearing like faced rights to each other, they can be interpreted like rights that make possible and demand a harmonious coexistence.
