In its simplest meaning, justice is the march or materialization of the resolution of conflicts of a certain social group or community. In accordance with this definition, the following pages want to show and reflect on how a group of conflicts are resolved in an intercommunal or external relationship within a group of Aymara communities in the South Andean region of Peru.

The objective of this text is to explain the nature of the Andean community institution that the peasant patrols have in order to support their demands for constitutional and legal recognition. This analysis starts from a pluralist interpretation of the Constitutional Charter of 1993 and the ILO Convention 169, in order to enrich the debate on the ongoing constitutional reform. The peasant patrols constitute a widespread form of Andean communal institution that exercises functions of local government, justice, local development, dialogue with the state and supra-local articulation.

This is an "introduction" to the law of indigenous peoples. Under that word I understand the necessary preparation to reach the proposed goal, in this case, to define what is understood as the right of indigenous peoples and the complications involved in that task. No book has been written on this subject in Peru. Indigenous rights are generally presented as an implicit issue in the approach adopted, for example, referring to peasant or native communities or to some international agreement. The legal idea of ​​the right of peoples, despite its antiquity, continues to motivate heated discussions, especially when it refers to indigenous peoples and self-determination.

The success of the Peruvian peasant patrols in the fight against subversion or as a result of a more autonomous local process of rural populations in combating rustling and other forms of external aggression has been widely documented in contemporary literature (see, among others, , Churats et al., 2001, Degregori et al., 1996, Guerrero Bravo 2001, Hernández 2000, Yrigoyen 2001). This success, together with the social breadth of the movement and its way of operating in areas supposedly reserved for urban political instances, has even led some authors to propose the Peruvian peasant patrols as "some of the most vital new ways of doing politics in the planet" (Starn 1992).

Since time immemorial, community or communal forms of conflict resolution have existed in the Andes. Pre-Inca cultural and social organizations such as Chavín, Tiahuanaco and Wari (to mention the best known) are an example of the level of development of these forms of resolution based on their social, cultural and religious relationships, as well as their daily needs. With the Inca Empire, this community justice was not lost. Although the Inca, his nobility and his church came to take precedence from the central government of Cusco, these community forms continued in the ayllus, in the regions and surely also in the four of them that comprised the great empire.
