Context: This article deals with the judicialization of politics.Objective: From the context of the discussion, explicit contradictions and ambiguities and the disquiet caused by them, it is intended to minimally clarify the elements and assumptions of the debate, placing the reader in the genuine sense of the controversy.Method: Analysis of the classic literature on the subject, to compare and confront concepts, classifications and distinctions.Results: First, to conceptualize the judicialization of politics and, thus, to distinguish the different related concepts. Second, understand the idea of separation of powers in the 20th century. And, third, to identify democratic hegemony as a decisive factor for understanding the controversy.Conclusions: Above all, we can see the mistake of opposing the judicialization of politics to the separation of powers when the malaise is, above all, the tension between the judicialization of politics and democratic hegemony.

Objective: We argue that intergovernmental transfers are a relevant element for understanding the Brazilian federative dynamics and, consequently, for public policies in Brazil. The article aims to answer three sets of questions: (1) What is the size of transfers in terms of transfer values? (2) Which are the federal public administration bodies that carry out these transfers, how much do they transfer and through which instruments? (3) What are the main subnational bodies or institutions that receive these transfers, in which regions and units of the federation are they located and what amounts of resources do they receive?Methodology: A classification of voluntary transfers established by the Brazilian State in the context of fiscal federalism, legal regulations and consolidated administrative practices is proposed. The empirical analysis is unprecedented and of a descriptive-exploratory nature.Results: The results show that, from 2008 to 2017, the average of resources transferred by the federal government underwent large variations, with a significant drop in the year 2013 to 2014. The most expressive values are from the Ministry of Health and Cities; Roraima, Acre and Amapá were, proportionally, the states that received the most funds from the federal government.Contributions: Federated entities are the main actors called to collaborate in the decentralized execution of federal resources. Strengthening the administrative capacities of the federal government is essential to improve federative coordination, while improving the implementation of public policies depends on strengthening subnational governments.

Objective: Over the past decade, arbitration has grown in popularity as a method of resolving commercial disputes worldwide. However, this practice is relatively new in Macao SAR. Recently, official plans were announced to make Macao as a seat of arbitration for commercial disputes between China and Portuguese-speaking countries (Hereinafter PSCs). This article is dedicated to explores the possibility of Macao undertaking and implementing such a role. Accordingly, this article addresses the following issues: What are the strengths and weaknesses of Macao as a seat and eventually as venue for hosting international commercial arbitration between Chinese and PSCs entrepreneurs?Methodology: A mixed-method approach of legal doctrinal and empirical research was used in this article. We first included a thorough study of the concept of arbitration followed by analysis of various legal journals and legislations, including Macao, China, and PSCs’ arbitration laws. An empirical research was then used to collect data by surveying and interviewing with both lawyers and arbitration practitioners from Macao, China and PSCs.Results: This article argues that the strength of Macao resides in the similarities between its legal system and that of the China and PSCs and the languages advantage (Chinese and Portuguese both official languages). In spite of this, arbitration is still relatively underutilized in the region, and there is a limited number of arbitrators and legal professionals with bilingual proficiency.Contributions: This article contributes to the identification of the opportunities and challenges that Macao faces in its potential future development as a seat/venue of arbitration between China and the PSCs.

Objectives: The present work aims to promote a reflection on the inclusion of Consensual Methods of Conflict Resolution in the National Curriculum Guidelines (DCNs) of Undergraduate Law Courses – Resolution CNE/CES nº 5/2018, with the changes introduced by Resolution CNE/ CES nº 2/2021 –, as mandatory content and practice, aiming at building a Culture of Dialogue.Methodology: The research was documental and bibliographical, qualitative in nature, exploratory in nature, working with deductive reasoning. The question that sought to be answered concerns the degree of insertion of Consensual Methods of Conflict Resolution in the current DCNs of Law Courses and the possible impact that such a measure may have on the construction of the Culture of Dialogue.Result: It is concluded that, with the implementation of the current DCNs, there is a legal requirement that Law students start to study, with greater theoretical and practical emphasis, the Consensual Methods of Conflict Resolution, giving rise to the modifyng the culture of managing of legal conflicts from a judicial sentence perspective to a consensus perspective.Contributions: The research showed that the topic is of great academic and professional relevance. And that, from the publication of the new DCNs, the Consensual Methods of Conflict Resolution, which were already characterized as a public policy of the Brazilian state, now become a mandatory part of the training of all future professionals in the field of Law.

Contextualization: In theme 280, the Federal Supreme Court (STF) established the thesis that forced entry into a home without a court order presupposes the existence of well-founded reasons. The Superior Court of Justice (STJ), in addition to establishing the idea of a probative standard for entry into the suspect's home without a court order, now also requires a demonstration of urgency for entry and voluntary consent, free of any kind of constraint or coercion, leaving the state authority with the burden of proving the legality and voluntariness of the resident's consent.Objective: Despite the change in the understanding of the superior courts, it is necessary to verify if there is communication between the understanding of the superior courts and the position of the Court of Justice of the State of Ceará (TJCE), using, for that, the Critical Analysis of Discourse (ACD), which proves useful in revealing the ideology behind legal discourse.Method: The research will use a bibliographical, legislative and jurisprudential review on the subject, using works from Theory of Law, Philosophical Hermeneutics and ACD, envisioning a dialectical analysis of the performance of the ECJ.Conclusion: it is understood that the Law must be applied, considering the reality of its operator. Thus, the current understanding of the Superior Courts has represented an advance in the protection of fundamental rights, reflected in the decisions of the TJCE, with the aim of inhibiting situations in which police authorities act, insistently, on the margins of the understandings of the Courts.

A survey was carried out with the government websites of 25 municipalities in the Metropolitan Region of Porto Alegre, this municipalities had less than 100 thousand inhabitants, with the objective of analyzing how Municipal Administrations are publicizing partnerships with Civil Society Organizations. The analyzed scenario was four years after the implementation of the regulatory framework, in the municipalities, and seven years after the law 13.019/2014 and the amendments made by the law 13.204/20105, which was a revolution in partnerships with the third sector.

The present work seeks to analyze the Programa Brasil Alfabetizado (PBA) in the light of Kingdon's Theory of Multiple Flows (2003), seeking to verify how this program is structured and has been undergoing modifications throughout its offer. For this, methodologically, descriptive qualitative research is adopted using document analysis through the legislation that regulates the PBA, with Decree number 6,093 and Resolution number 32 being selected due to data made available as more recent at the time of execution of the search. As a result, it can be seen that from the theory adopted for analysis, addressing issues related to the flow of problems, flow of alternatives and solutions and political flow, it was possible to verify as preconditions for the institution of the PBA and how it is structured, even though, regarding the modification processes, the analysis has been limited since the Theory of Multiple Flows focuses more specifically on the preconception of public policies.

The present study aims to investigate and discuss the impacts of the academic literacies model on the initial training of pedagogues, academics of the Pedagogy course at a public university in the rural town of the State of Rio Grande do Sul. The competences development from the perspective of the academic life's demands related to other factors in addition to the technical-scientific domain and socialization, mobilizing senses and relationships of identity and power, including the formation of a teaching identity. Under a qualitative approach; as for its objectives, the study is part of an applied research. Methodologically, it uses the content analysis technique, guided by the exploration of data, inference and interpretation of the participants' statements. The results indicate that, among other aspects, engagement is build from the insertion in diversified practices in situated contexts, which potentiate meanings and subjectivities. It was possible to identify the significant power of the different modes of interaction with academic practices for the improvement of relevant literacies in the face of experiences at the university and the performance of the future pedagogue.

The speech and the different languages we use to communicate are determined and influenced by the culture in which we are inserted. New linguistic expressions, gestures and symbols emerge all the time and are inserted into our everyday speech in a natural way. It is important to analyze the new expressions so that the context in which they are inserted is understood. One of those cases is the expression “mulherão da porra”. This article analyzes three occurrences of this expression in texts of different genres – in the blog “DescomplicaosTrinta”, in the chronicle “O que é um mulherão da p.?” and in the video clip “Mulherão da porra”, by the duo “Munhoz e Mariano” – in order to verify if the expression adds to the feminine universe this meaning linked to masculine virility through the use of the adjective phrase “da porra” (in Brazilian Portuguese, “from semen”) as a positive reinforcement, empowerment or as an equivalence of forces. Through the analysis, it was perceived that the expression is generally used as an emphasis on female empowerment and the equalization of forces between genders. Furthermore, it connotes a pattern of women who are, in common, beautiful and financially prosperous, indicating that the expression varies greatly in its meaning, depending on the discursive objective of the user.

Este Número Especial da Revista Eletrônica Científica da UERGS é dedicado às Ciências Humanas e Sociais, composto por seis artigos. A Revista Eletrônica Científica da Uergs traz a público artigos recebidos na chamada especial da área, contemplando temáticas interdisciplinares, voltadas às informações sobre o ser humano e suas relações, buscando compreender fenômenos sociais, históricos e culturais. Trazemos nesta edição estudos que se propõem de alguma forma à prática do diálogo interdisciplinar, buscando olhar para diferentes objetos de pesquisa como a formação docente, a relação da linguagem e o empoderamento feminino, programa de alfabetização de jovens, adultos e idosos, o marco regulatório na administração pública, a avaliação formativa na área da saúde e os problemas enfrentados por gestores atuantes nas Unidades Básicas de Saúde.                O primeiro artigo, de autoria de Cátia Cilene Diogo Goulart e Veronice Camargo da Silva, A influência do modelo de letramentos acadêmicos sobre a formação docente, evidencia a importância da interação com as diversas práticas sociais que se dão no meio acadêmico para o letramento e formação inicial de futuros pedagogos. De cunho etnográfico, os dados da pesquisa foram gerados em contexto de ensino virtual, durante a pandemia de Covid-19, com a observação de uma turma de primeiro semestre de graduação, suas interações com o professor universitário e suas produções textuais. Neste artigo, as autoras exploram dados de uma interação via fórum, que representa apenas um recorte da pesquisa que objetivou investigar a relação entre o modelo de letramentos acadêmicos e a formação profissional de docentes de um curso de Pedagogia. O autorrelato dos participantes revela que o trabalho com os gêneros discursivos em contextos situados ampliou os letramentos acadêmicos e a reflexão crítica dos graduandos em relação às suas identidades.                Liziane Giovana Klein e Ana Maria Bueno Accorsi assinam o artigo intitulado Cultura e linguagem: concepções da expressão “mulherão da porra” em textos de diferentes gêneros. As autoras analisam a ocorrência da expressão em três contextos discursivos distintos, nomeadamente uma postagem de blog, uma crônica e uma canção, por meio de abordagem investigativa de análise do discurso. As autoras propõem uma reflexão crítica sobre os significados e os usuários dessa expressão que recorre à virilidade masculina para incentivar o empoderamento feminino.                O trabalho Programa Brasil alfabetizado: uma análise à luz da teoria dos múltiplos fluxos de Kingdon, assinado por Jaíne Motta Santana Abrahan e Guilherme Ribeiro Rostas, centra-se na discussão sobre a estrutura desse programa que visa alfabetizar jovens, adultos e idosos, especialmente em municípios com alta taxa de analfabetismo. Por meio de análise qualitativa, apoiada no Modelo de Múltiplos Fluxos, os autores investigam os documentos oficiais que normatizam o programa buscando compreender a agenda governamental que subjaz a esse instrumento de política educacional. A partir dos resultados, os autores refletem sobre as mudanças na agenda governamental relacionadas ao programa e possíveis razões.                Em Marco regulatório na administração pública municipal: uma análise da sua implementação na região metropolitana de Porto Alegre, Daiane Scartezini Carreño e Ana Jussara Silva do Nascimento ressaltam a importância das parcerias entre a Administração Pública e as Organizações da Sociedade Civil para a execução de projetos de interesse público e recíproco. Através de pesquisa documental e bibliográfica, as autoras analisam a lei que regulamenta as parcerias e investigam a transparência dos processos do Marco Regulatório em 25 municípios do Rio Grande do Sul. Os resultados do trabalho apontam para um cenário ainda inicial de publicação de documentos relacionados às parcerias. No artigo Rubricas para avaliação formativa no ensino na área da saúde: uma proposta no conteúdo de incontinência urinária feminina, Maria Bethânia Tomaschewski Bueno e Maria Isabel Giusti Moreira discorrem sobre o uso de instrumentos de avaliação no processo de ensino e aprendizagem. O trabalho relata um recorte de uma pesquisa realizada em contexto de formação inicial em Fisioterapia na qual foi elaborada uma Sequência Didática para o ensino de conteúdo relativo à incontinência urinária feminina. Os resultados da pesquisa potencializam as discussões acerca do papel da avaliação na formação crítica e reflexiva de profissionais da área da saúde.                Jane Maria Izaguirre e Rita de Cassia Nugem, no último artigo da edição, intitulado O gestor nas unidades básicas de saúde no Brasil: uma revisão da literatura, apresentam uma revisão integrativa da literatura sobre os problemas enfrentados por gestores atuantes nas Unidades Básicas de Saúde. A coleta de dados abrangeu artigos científicos de acesso livre publicados entre os anos 2000 e 2020 em bases de dados na área da saúde. Os resultados apontam problemáticas diversas e algumas questões recorrentes encontradas e enfrentadas pelos agentes responsáveis pela gestão das unidades. As autoras refletem sobre a necessidade de investimento na formação em gestão para capacitação e permanente aperfeiçoamento dos gestores, além da possibilidade de cogestão de forma coletiva dentro das unidades. Nesta Edição Especial das Ciências Humanas e Sociais trazemos a público trabalhos que apresentam contribuições de pesquisadores de diversas instituições de ensino superior do Brasil. Movimento este que reforça a credibilidade que esta revista tem conquistado.
