Resumen
The exercise of the public service implies that, with respect to the Administration, every public servant has a number of subjective legal situations which emanate from the formal and material status that binds him or her within the framework of his or her functional relationship. In this framework, certain constitutional principles that provide the conceptual and ontological basis and support human work in a State Administration are also applicable. The development of the functional relationship may require that, in view of the effective needs of the service, such legal situations be modified, which would constitute a functional jus variandi,for which certain principles also emanating from the constitutional text are also imposed, which constitute a limit imposed on the legitimate exercise of said power

This paper will highlight the position of the 1st, 2nd and 3rd Turn Labor Appeals Courts regarding the admissibility (or not) of the subjective initial accumulation of claims against the same employer, that is, whether a group of workers can sue, jointly and in a single process, their employer for payment of labor costs. For some years now, judgments have questioned the application of such an institute —of the initial accumulation— within the framework of the independent labor process set forth in Law 18,572. The object of this collaboration will be the analysis of the arguments of such judgments that, without a doubt, have great academic and practical relevance

This article analyzes the judgment issued by the Inter- American Court of Human Rights on June 6, 2024, which addressesthe violation of the rights to judicial guarantees and judicial protection by virtue of the delay by the State of Peru in satisfyingthe interest of the victims, as well as the violation of the rights of association and collective bargaining, among others.

Resumen
This paper analyzes a case composed of two judgments, where the actor petitions through an ordinary trial for various items, including abusive dismissal. The cause of the claim for special compensation alleged by the plaintiff lies in the violation ofhis freedom of association. Specifically, he points out that he was dismissed because of his union activity. The judge accepts the claim, arguing that the defendant failed to prove reasonable cause for the plaintiff’s dismissal. The Court confirms the first instance ruling,going deeper and deeper into the arguments on the point made in the first instance. The central issue in the case is the protection of freedom of association as a fundamental human right.

Resumen
Based on a controversial court ruling, this paper analyzes the scholar and judicial issue of detrimental and tacit novations (in peius) and without granting employees monetary compensation. It is concluded that valid novations require existence of a real agreement between parties (given by three elements: understanding; compensation; and reasonableness), which should be analyzed at the time the agreement occurs and without considering the maintenance of the labor source as sufficient compensation by itself.

El 6 de marzo de 2025 ha partido don Emilio Morgado Valenzuela a los 92 años. Chileno, abogado, casado con Lolita Maurtua Cárdenas, su encantadora mujer de nacionalidad peruana, le suceden dos hijas, Lucía y Patricia. Un gran jurista, pero, sobre todo, una gran persona. Los testimonios de pesar en las últimas semanas dan cuenta de la huella que dibujó en vida, construyendo amistad y buenas vibras. Era el reflejo de una concepción sobre la vida y la sociedad, armonía y progreso, pero también el fundamento de sus sueños por la igualdad y la justicia social.
