En medio del actual contexto de expansión de la criminalidad en el Perú, el presente artículo tiene como objetivo analizar la vinculación entre crimen organizado, corrupción y lavado de activos. Para ello, se abordan las características esenciales y tipologías del crimen organizado y la relación existente con los delitos de “cuello blanco” en el entorno peruano. Asimismo, se realiza un análisis crítico de la política criminal peruana frente a la criminalidad organizada de “cuello blanco”, con especial énfasis en la criminalización secundaria, advirtiendo una tendencia de “mano blanda” o de menor rigor del poder punitivo estatal ante este fenómeno.

The crime of abuse of economic power in Peru has undergone a fluctuating regulatory evolution, reflecting the tension between criminal intervention and administrative regulation in economic matters. Its criminalization, currently contained in article 232 of the Criminal Code, responds to the need to punish anticompetitive practices of absolute prohibition. In this context, the competence of INDECOPI to previously establish the existence of an administrative infringement introduces a referral mechanism that conditions the criminal prosecution.

Arbitration has emerged as a prominent alternative to judicial adjudication for the resolution of disputes, gaining substantial social and economic significance. Despite its growing prominence, the role of criminal law in regulating and addressing misconduct within the arbitral process remains underexplored. This article posits that the existing criminal law framework is insufficiently equipped to effectively respond to potential criminal phenomena arising in the context of arbitration. Considering this, the study examines the current provisions and available responses within the Peruvian and Spanish criminal codes, highlighting both their strengths and limitations in confronting the unique challenges posed by arbitration-related offences.

The article examines tax regularization in the Peruvian legal system, focusing particularly on the foundations that legitimize it, the requirements for its application, and the challenges faced in its practical implementation. The significance of this legal institution lies in its capacity to exempt the perpetrator of a tax crime from criminal prosecution, provided they inform the authority of their unlawful act and pay the full amount of the tax debt generated by the offense, plus interest and the fine. The criminal policy considerations that justify waiving criminal prosecution prioritize the effectiveness of tax collection and acknowledge the achievement of criminal law objectives through this mechanism. The article is structured in five sections comprising: i) an approach to the institution of tax regularization, ii) the foundations of legitimation, iii) the discussion of its legal nature, iv) its requirements, and v) the challenges of practical application in Peru.

With the rise of State interventionism in the economy, which can be seen at the beginning of the twentieth century, some Criminal Statutes sanction behaviors that injure or endanger such intervention, that is, economic crimes. This trend, which arose in Europe, spread to Latin America in the eighties and is evident in the Penal Codes issued from that moment on. This article seeks to analyze the way in which these criminal behaviors appear and are updated in the legislation of Latin America.

The author concludes that the recognition of the “civilly liable party”, invoked by Peruvian criminal jurisprudence in recent years, as a procedural party in Peruvian criminal proceedings, is derived from the provisions of article 111 of the Code of Criminal Procedure.And she argues that it is important to differentiate the civilly liable party from the civilly liable third party, since it is frequent that in the criminal proceedings these institutions are confused; supporting, for example, the incorporation and liability of the civilly liable party with the rules that govern the civilly liable third party, despite the fact that they are institutions with different nature, rules and legal consequences.

The general objective of this document is to present a collaborative educational experience, which is based on the principles of constructivism and competency-based teaching. Through the active methodology, during the semesters 2023-1, 2023-2 and 2024-1, the students of the elective subject "Editorial Production" of the Bachelor's Degree in Communication Sciences of the Autonomous University of Baja California, create the student magazine Ser Humanxs. In this process of learning to do (which is divided into two phases, a conceptual and a practical), students assume the leading role in all stages of the editorial process, while the teacher acts as a mediator. Through the teaching-learning model in a real space and with meaningful experiences, as a result, students develop skills to build knowledge, effectively integrating theory and practice for the creation of a communication product. In addition, they recognize themselves as part of a dynamic community and acquire useful tools for their future working life.

This article analyses the structure of so-called crimes related to breaches of duty and special crimes of duty. It specifically aims to understand the foundation of duty that forms this structure. To achieve this, the research focuses on the various concepts of “positive duty” that underpin the classification of a crime as either a violation of duty or a special duty. The goal is to demonstrate the significance of establishing a duty as positive. We will also explore how attributing criminal responsibility in certain economic crimes, such as unfair or fraudulent administration, relies on this foundation.
