A comienzos del siglo XI, la Historia Normannorum de Dudón de San Quintín se constituyó como la primera narrativa que definió una identidad étnica normanda (normanitas) común para la élite gobernante de un principado que se consolidaba como el más poderoso del norte franco. En este trabajo, nos centraremos en analizar la obra del canónigo y en caracterizar algunos de los rasgos principales de la gens Normannorum, considerando que este fue un momento culminante de su proceso de etnogénesis.

The prosecution of crimes committed within the armed conflict in Ukraine is probably the most arduous challenge faced by the international criminal system since World War II. The involved actors have not ratified the International Criminal Court Statute, and the alleged implication of an active head of state and permanent member of the UN Security Council (Russia) with veto power, prevents the activation of mandatory jurisdiction of the Court. In this point emerges the idea of a special tribunal to judge the crime of aggression in Ukraine. Would a treaty to establish it be legitimate, considering that one stated directly incumbent would not recognise it? Would not it be a reversal of the system, since the Court was born precisely to close the ad hoc courts that proliferated in the last century?

This paper examines the USMCA (United States – Mexico – Canada Agreement) negotiation process that led to the replacement of NAFTA (North American Free Trade Agreement), fulfilling a key Trump-era promise. Focused on Chapter 14’s investment provisions, our analysis uncovers the different outcomes for government contract investors, that were able to maintain the protection levels and ISDS (investor-state dispute settlement) access, to the detriment of other investors. Emphasizing the legal framework involving 25 advisory trade committees linked to the United States Trade Representative (USTR), we scrutinize a 40-document corpus, revealing the significant influence of interest groups, notably the National Manufacturers Association. Findings illuminate the intricacies of economic agreement negotiations and underscore lobbies’ substantial impact on U.S. foreign economic policy formulation.

This article zooms in on the rather unexplored history of indirect expropriation in international investment law. It argues that two major shifts have taken place in its evolution since its inception around 1917. The first concerns its transition, throughout the 1960s and 1970s, from a residual norm protecting investors while accommodating the right of states to pursue public interest, to a markedly neoliberal device providing a considerably higher level of protection for investors. The second shift, around 2000, marked the return to a moderately statist paradigm, largely under the idea of police powers. The article uses this historical reconstruction to reflect on the dynamics of norm change in international investment law and in international law more generally. It suggests four theoretical factors recognizable in the trajectory of indirect expropriation and arguably central in the evolution of any international rule: norm instability, low institutional authority, the interests of powerful states, and public oversight.

From the depathological version of the trans phenomenon, we analyze the new practices that international human rights law requires of States regarding the recognition of the right to self-perceived gender identity in childhood, based on a series of historical, theoretical and conceptual assumptions that have given rise to its recent study.  At the end, reference is made to the Argentinean regulatory model that emerged after the enactment of Law No. 26.743 on Gender Identity, and the way in which it became the reference framework for other States in the world to create an inclusive legal order towards any bodily and gender diversity.

This text aims to analyze how the issue of sexual rights has been incorporated into the agenda of the Inter-American Human Rights System, especially concerning the protections of transgender and transsexual people. To this end, it draws on the important and recent Advisory Opinion (AO) 24/17, while also considering the significant impacts of this instrument on Brazilian domestic law, particularly through the Declaratory Action of Unconstitutionality (DAU) 4275/DF of the Federal Supreme Court, highlighting a possible and fruitful dialogue between the Courts. The method used is hermeneutic phenomenology.
