Resumen
This article analyzes the right and guarantee of people with disabilities to participate in political and public life in conditions of equality with others, in the regulation established by the National Congress to protect and promote their participation in the election of conventional constituents and in the mechanisms designed by the Constitutional Convention to exercise their rights in the discussion and adoption of the Proposal for a New Political Constitution, taking into account the social barriers they face in exercising them. Likewise, it emphasizes the need and importance of legislative measures, as a duty of the State, to enforce the fundamental rights and freedoms of persons with disabilities and analyzes the principles of pre-eminence of human rights, equality and the prohibition of discrimination and the participation mechanisms established by the Constitutional Convention to promote, respect and guarantee human rights, considering their universality, indivisibility, interdependence and interrelation.

Resumen
The demands for the constitutional recognition of indigenous peoples have been echoed in the discussions on a new constitutional framework for Chile, opening the discussion to the recognition of indigenous legal systems, abandoning the prevailing monist tradition. The recognition of legal pluralism implies a complex task of adaptation of the institutions of the non -indigenous system, in which the experiences of other Latin American countries can be useful for the identification of the main problematic knots that must be taken into consideration, for the recognized coexistence of diverse legal systems. The recognition of indigenous normative systems implies reinforcing the State’s commitments in terms of access to non-indigenous justice for indigenous peoples, insofar as it implies the incorporation of an intercultural perspective in the exercise of the jurisdictional function. In order to contribute to these discussions, some comparative reflections and the essential elements for the legislative process that constitutional recognition implies are presented.

Resumen
This comment critically examines the judgment of the chilean Supreme Court on the appeal on the merits deducted against the judgment of the Court of Appeals of Santiago that confirmed the rejection of the impugnment and the claim of paternity established in the «notorious possession» of the defendant’s son. The comment celebrates the broad interpretation of the articles 200 and 201 of the Civil Code made by the Supreme Court while briefly analyzing the arguments put forward by it, and raises the possibility of interpreting the decision of the Supreme Court as an implicit recognition of the right to care.

Resumen
When asked, why do we obey the institutions, the State and the law? The moral answer indicates that we do so because we value something in those institutions. The Chilean philosopher Jorge Millas will say that what we value is freedom, and it is in this sense that he defends the Kantian moral principle that the human being is an end and never a means. In this scheme, violence operates as the opposite of freedom and said principle, therefore, it would be the opposite of institutions, the State, law and morality. But, this work will try to show how that same right and that same morality can mask and justify state and institutional violence. Thus, it will try to explain the complex process in which law and morality end up being emptied of meaning, ending up being instruments of violence. Also, as a way of reinforcing the Kantian principle, an attempt will be made to vindicate Judith Butler's modulation of the Kantian principle, which resignifies it in the principle of mourning for lost lives; Criterion that allows to give a concrete sense to the idea that the human being is an end and not a means.

Resumen
This project proposes and develops a series of interconnections between the fundamentals of Human Rights (HR) and Critical Discourse Analysis (CDA), conceiving them both as related disciplines with constituent elements which share certain points. This analysis takes into account elements from the hegemonic conceptualization of HR, as well as from their critical perspective, enrichening the common points found with CDA, with the aim of offering an integral approach that may lead to tools for social changes.
