Resumen
Fundamental rights are essential part of current constitutional democracies; however, the protection and guarantee of fundamental rights by the State is not an easy task, since the democratic bodies of the State and the legislators face every time more challenges. Therefore, the legal doctrine of the fundamental rights play an important role since they offer tools for a greater understanding of the function, structure and dynamics of rights. Among the diverse items to discuss, this text attempts to offer a small portrait of the discussion regarding the relationship between what protects a rights and those reasons justifying the restriction of said protection. This differentiation is necessary since by it not only is the role of the legislator as first drafter and guarantor of the fundamental rights set at the center of the discussion, but also, it is a necessary requirement for relevant legal concepts, such as the analysis of proportionality.

Resumen
This article reviews the ideas and initiatives of the politician and legal expert Mariano Otero regarding the imprisonment reform proposed and partially developed during the XIX century. Otero, well known by his contributions to constitutional matter and about amparo proceedings (consider the so called “Otero formula”, incorporated in 1847), has not been as recognized regarding his studies and proposals in criminal and imprisonment matters. This famous liberal from the state of Jalisco had a clear consciousness of the relevance of criminal legislation within the tasks of the State and of the need of — always present— renewing the imprisonment system and fostering a good treatment for the inmates. He had the influence of treatise writers and reformers of the XVIII century, such as Jeremias Bentham and John Howard. In his conceptualization, it was necessary to adopt the so called “Philadelphia” system, which called the attention worldwide and attracted new European visitors, as Tocqueville and Beaumont, who wished to know the advance made in the United States imprisonment centers.

Deliberation and Popular Sovereignty in the Constitutional Reform of Mendoza: Finding the Legitimacy

In the reform process of the yore Constitution of Mendoza, this project has as purpose explaining the tensions occurring in constitutionalism as to popular sovereignty, el constitutional branch and the place of the people. In this theoretical framework, the hypothesis adopted consists of the difficulty to materialize constitutional change obeys to the attempts are exclusively addressed to legal procedures, which were not designed to favor the democratic and discursive exchange of reasoning between the State and the people. Facing this problem, the development of “extra-constitutional” practices derived from a deliberative theory of democracy, will contribute to provide democratic legitimacy to the actual reform.
